McDonald case prediction time
i thought that since monday is most likely the big day we could make some predictions. Heres mine:

I think the case is not going to be clear cut as heller. I think there will be multiple issues decided with differing majorities. Here goes; 9-0 in favor of incorporation with a 7-2 majority saying that the incorporation goes far enough to strike down the handgun ban. I think if there is going to be a decision on scrutiny its going to be a 5-2-2 in favor of some form of intermediate scrutiny (with the standard "heller 5" in the majority.) 2 dissents will be issued; one arguing for a lesser scrutiny test and the other arguing that the court shouldnt even take up the issue of a scrutiny test (leaving it to be hashed out in the lower court)

1. Because of how the assignments of other majority opinions . . .
. . . have gone so far this Term, the betting is that the McDonald majority opinon has been assigned to Justice Alito. FWIW.

As despite Mayor Dick's devout wishes that no one notices, there certainly is a lot flowing already.

During which a reporter did say that blood was running in the streets of Chicago.

I believe he also referred to the CPD as "a bunch of thugs".

10. I fear that the "extremists" who want the Constitution to actually be followed
will be disappointed by the Court's faint support for the supreme law of the land. I also believe those who think the government can totally ignore the Second Amendment will be disappointed.

I guess that means we agree, after a fashion.

I don't trust the Court to do the right thing. They bend over backwards to allow the government to do "reasonable" things that violate our rights.

11. At least some attention is paid to
the 2nd, in the mean time there is nothing left of the 7th. Juries are overturned every day and more and more caps and torte reforms.
