Couple attacked at movie theater

MANATEE – A Marine and his wife were attacked outside a movie theatre Christmas night after asking a group of teens to be quiet during a movie.

The attack escalated into an fracus attracting approximately 300 bystanders. As a result, four teens and an adult were arrested, according to Manatee County Sheriff’s Office reports.

Federico Freire, 27, who is on leave from Afghanistan, went to the movies at the Carmike Royal Palm 20, 5125 26th St. E., to see "Little Fockers" with his wife Kayln.

Freire said a group of about 20 teens were being obnoxious and loud during the movie. When they were asked to be quiet, some of teens began cussing. Kayln Freire went to find a manager and the youths were asked to leave. The couple left shortly afterwards.



A witness said he had a firearm in his vehicle and offered to escort the couple to safety. Federico Freire said he told his wife to go with the witness to get her out of harm’s way.

Seven males then surrounded Federico Freire and began to kick and punch him.

“I got back up to defend myself and they started running everywhere,” he said. A crowd of more than 100 people began to form.

When Freire looked over at his wife, he saw a young male with his shirt off who punched her in the face, knocking her out. Freire went after the youth and the witness brandished his gun telling the crowd to step back.

I still see no reason to the hooligans with DEADLY force.

A punch in the face does not rate a death sentence.

And, as we know all too well, a fist can be a deadly weapon.

So yeah, I think it was justified.

Requiring you to continue defending yourself with your off hand .

The best tactic is to not disrespect the little rascals when you encounter them in their environment and just let them do whatever the hell they want . Or they will fuck you up . lol . If they challenge you , drop to the ground and play dead . No matter how many times they kick you , do not move or react . Eventually they will be distracted by some other fool that has made eye contact and wander off to fuck him up .

Or alternately , hit them with your purse , and then fall down screaming .

Nor do they share the great strength , physical and mental superiority , or even the company of great warriors trained from birth to rip the still beating hearts from their enemies chests with their bare hands .

They do however share their cities with these little rapscallions . Which is why I am so quick to recommend playing dead or a sincere offer of otherworldly fellatio as an alternative to fisticuffs and gun play .

9. So... shoot them in the pelvic girdle or lower spine.
They may or may not live, but if they do... guaranteed that they'll find it pretty damn difficult assaulting anyone in the future from a wheelchair or walker.

On the positive side... they'll get reserved seating next time they go to a movie.

Explain what super ninja skills you might possess to make those good odds in stand-up fisticuffs?

The Marine went after the shithead who punched out his wife. Do you expect him to do otherwise?

The witness kept the crowd off the Marine. Seems pretty reasonable to me. You come boiling out of a hostile mob would indicate to most folks you are looking to get shot.

"If you're looking for trouble, I'll accommodate ya....otherwise leave it be," makes sense to me.

Your first sentence appears to be missing a verb ("no reason to ____ the hooligans"), but let me assume for a moment the missing word is "threaten."

There's a term, disparity of force, that's used to indicate when an altercation is so unbalanced that an observer would reasonably conclude that the disadvantaged party might readily suffer permanent injury or death, even if the assailants had no weapons, thereby justifying the use of lethal force in self-defense. Typically, when the assailants outnumber the assaulted by three to one, it's accepted as constituting a disparity of force. In this particular instance, the assailants outnumbered the Freires and the unnamed witness by at least seven to one (the 15 girls who surrounded Ms Freire, the 7 guys who started beating on Mr. Freire, for a sub-total of 22, and possibly the guy who punched Ms Freire if he wasn't one of the aforementioned seven assaulting Mr Freire).

Your use of the term "death sentence" is inappropriate for two reasons.
The first, and more obvious reason, is that nobody was shot, let alone killed.
The second is that a death sentence is a judicial punishment imposed after the fact; its purpose is not to avert an imminent threat of permanent injury or death to the victim of the assault, and must therefore be based on what can be ascertained to have happened. By contrast, the use of lethal force in self-defense, to be considered legitimate, must serve to avert what may have reasonably have been judged, on the basis of information available at the time to the wielder, an imminent threat of permanent injury or death to an innocent party. True, you can't legitimately shoot a guy for punching someone in the face, but you can legitimately shoot him if you reasonably believed at the time that the guy intended to keep punching, kicking, etc. until the victim was permanently injured or dead, and were trying to avert that outcome.

Of course, using force (lethal or otherwise) or the threat thereof to intervene in an unlawful assault inherently creates a paradox, in that by intervening in order to avert an undesired outcome (to wit, the infliction of permanent injury or death upon an innocent party) it becomes ipso facto impossible to say with certainty that said outcome would have come about absent the intervention. Of course, if the alleged assailant survives the shooting, you can count on him to collect that year's Mandy Rice-Davies Award in denying he intended to inflict permanent injury to death on the victim (http://en.wikipedia.org/wiki/Mandy_Rice-Davies#.22Well.2C_he_would.2C_wouldn.27t_he.3F.22_and_later_celebrity).

13. That is too close to the truth.
If you put the bullet where it needs to go a .38 special will do the job. You don't have much margin, but that is the price you pay for something small and easy to carry.

Every now and then the subject of concealed carry guns comes up at work, and often some guy will describe an absolutely wonderful rail equipped, double stack, laser-sighted, custom cannon as his carry gun.

"WOW! That sure sounds like an impressive piece of ordnance, may I see it?"

"Uh..........er...........h'mm, lemme run out to the truck and get it."

By then someone in the office will have produced a Kel-Tec or an Airweight Smith.

"What's with the silly little pop gun?"

"That's what keeps you from getting to your truck."

If a gunfight is on the schedule, and I HAVE to be there, I'd just as soon show up with an M256 120mm tank gun and riding in an Abrams. Otherwise, I carry what season, clothing, political climate, and the law will allow. For me, that's a Colt Commander when a jacket is appropriate and a Colt Cobra when it's not.

Carry or don't. It's not a fashion choice. You don't start the day peering into the gun safe like Imelda deciding on a pair of shoes. Life is not like "bowling with bullets."

15.  Just a little to much firepower
For wanna be gangers, or even hard core ones a M4 half track with a quad fifty AA mound is all you need. 4000 rds of BMG takes care of a LOT of gangers.

Easier on fuel and less collateral damage.

Either, you should not have a gun or two being punched does not necessitate deadly force. Yes it does. Punches turn to kicks which can turn into hitting with blunt objects and often people die or are changed for life. If a group of thugs attack me and my family like this I will shoot them if I have to. But just showing a gun can cause the cowards to run away.

23. I carry inside when I go to a movie.
The theater has a "no guns" sign, but it doesn't meet Texas 30.06 specific signage law requirements so it has no legal force. I carry concealed so the theater people don't know.

However, I would not have approached the teens. I would have realized that would have been taken as a challenge to them, and doubly so since race was involved. I would have sacrificed the price of the tickets and quietly left. When you carry a gun you take extra steps to avoid situations that might turn violent.

25. I really don't think you need to be so obsequious.
Politely asking someone in a theatre to be quiet so everyone else can enjoy the movie is hardly confrontational, no matter how the other party sees it. If they continue to be rude and you go to speak with the manager, they have no legal or moral entitlement to do you harm.

I think that part of the problem with the current state of society is that we put up with entirely too much bad behavior.

26. Note that Mr. Freire (the Marine) wasn't carrying
The only firearm involved belonged to the unnamed witness, who came to the Freires' aid when the situation was already looking ugly.
