GUNS IN THE NEWS--April 6, 2004
As CO Liberal sez:
Please try to adhere to the following voluntary guidelines, in order that we can have an orderly discussion of gun-related news topics:
1 - Feel free to add any CURRENT stories to this thread by replying to this message. In order to be considered current, stories should have been originally posted on the Internet within the previous 24 hours, or provide follow-up to a story that was previously posted on the J/PS board. On Mondays (since many people do not log in to DU over the weekend), stories can be posted from Saturday, Sunday, or Monday.
2 - Both pro-gun and anti-gun stories, editorials, and press releases are welcome in this thread, as long as they're current. Please do not post links to items from a few years back that support your position.
3 - Bear in mind that any links to extremely right-wing sites (such as Newsmax, CNS, or the Washington Times) or intentionally pro-gun or pro-control sites (such as the NRA or the Brady Campaign) are not considered reliable sources by many DU-ers. If at all possible, try to find a link for your story from a more mainstream source, such as a general-circulation newspaper or magazine site. If you choose to use a slanted site, be prepared for any negative feedback you may receive.
4 - Do not change story titles. In other words, if the Oskosh Gazette's web site runs a story titled "Two Killed in Holdup", the title of your message should read "Two Killed in Holdup". Don't change it to "Gun Owner Kills Two People", or anything else that changes the meaning of the story.
5 - If it's not clear from the title where the story occurred, add the city, state, or country in parentheses after the title.
6 - The person adding a news story to the "GITN" thread is allowed (and encouraged) to comment on that story, indicating their position on the topic being discussed. These comments can appear either at the beginning or end of the post; if possible, place comments in a different typeface so readers can separate the comments from the story. Others who wish to comment on a posted story can do so by replying to that story; this allows other readers to follow the comments by scrolling through the subthread.
7 - Please direct your comments to the story, rather than attacking the person posting the story or any person responding to the story. 1. Indiana Man sentenced for firing gun at teens (PA)
Another law abiding responsible gun owner....NOT.

"A man was sentenced to 11 1/2 to 23 months in jail after pleading guilty to charges that he chased a car carrying four teenagers while firing a handgun from his truck window, injuring a pregnant girl.
But Thomas Mock Jr., 44, of Burrell, won't spend any more time behind bars, since he got credit for the year and a half he spent in jail awaiting trial. Mock pleaded guilty but mentally ill last week to aggravated assault and reckless endangerment.
Police said Mock chased the car, shooting a revolver, for about four miles on state Route 119 in Indiana County on June 6, 2002. One of the bullets hit a 16-year-old pregnant girl in the head. She walked away after the car stopped and the bullet was removed from her skull a month later."

2. 'No guns allowed' is sign of times as law takes effect (OH)
"YOUNGSTOWN — Sure, Ohio now has a concealed-carry law, but once you get a license, your hidden holstered gun may not be welcome everywhere you want to go.
Like spring flowers, signs that prohibit firearms are popping up everywhere.
Businesses, including The Vindicator, that don't want employees, visitors or customers to enter armed are posting warning signs. Violators face a misdemeanor charge.
The concealed-carry law takes effect Thursday. That day, sheriffs' departments will begin processing applications, and licenses are expected to be ready within 45 days.
So, sometime in May, licensed Ohioans will be out and about with their guns.
For businesses that choose to prohibit firearms, the Ohio Attorney General's Web site at www.ag.state.oh.us suggests the type of sign to use. The sign features a handgun inside a circle with a diagonal line through it."

The list of so-called "forbidden carry zones" could conceivably include every place a person may travel on a particular day. Public buildings are out, as are schools, churches, day-care centers and universities. That basically leaves privately owned buildings and businesses, but each of them can post signs banning guns if they choose.
And cities -- which thought they had the power to ban guns from public parks before the law passed -- are finding out that power will get a lot murkier Thursday when the new law takes effect.
The question of where guns cannot be carried under the new law has businesses and local governments searching for answers and making preparations.

"COLUMBUS -- The state's long-debated new law allowing residents who pass criminal and mental background checks to carry concealed handguns goes into effect Thursday, and thousands are expected to flock sheriffs' offices across Ohio seeking new permits.
But whether the law is ultimately effective at making people safer may never really be determined.
"If the crime rate goes down in Ohio, they'll claim it's because of this," said Sen. Eric Fingerhut, D-Cleveland, one of the legislature's most outspoken opponents of the new law. "If it goes up, they'll say it's because the law is too restrictive. It's not a debate you're going to resolve ever."
That doesn't mean people won't spend the next few years giving it their best try.
Gerard Valentino, central Ohio coordinator for Ohioans for Concealed Carry, said Michigan crime rates dropped after it passed a concealed-carry bill in 2001."

7. Stolen Historic Guns Recovered (MO)
"Authorities at Wilson's Creek National Battlefield were relieved Monday to learn federal and county investigators recovered three missing guns, taken from the Battlefield Visitor's Center in January.
A federal grant jury indicted George Doos, 44, of Springfield, with possession of a stolen firearm. Doos was arrested Friday after the indictment was issued. Investigators recovered three historic firearms that had been on display at the National Battlefield southwest of Springfield.
The guns, one of which was actually used in the 1861 battle, were taken during a burglary at theWilson's Creek Visitor's Center on Janualy 11. The guns included a 1849 Colt Pocket Revolver, a 1842 Percussion Pistol - Caliber .54, and a 1851 Colt Navy Revolver."

"From his desk at the Tacoma police firing range on the Tideflats, Sgt. Jim Bass can watch officers shooting at paper targets outside.
He also can keep an eye on the weapons vault and see who's coming and going, though strangers rarely wander in because the range isn't open to the public.
On his computer, the 34-year police veteran can pull up databases and see who's got a department-issued handgun or rifle, and when they last were tested with the weapon.
Bass, who returned to oversee the firing range last August, created the databases to better track the weapon inventory.
The lack of that kind of master list was one of the criticisms leveled against the department by a state audit released last month."

9. Man arrested at Cork Airport after gun scare (Ireland)
"Gardaí in Cork have arrested a man who attempted to board a plane at Cork Airport last night with a pistol in his luggage.
The gun was spotted as the man tried to pass security in the main terminal building.
Reports this morning said the man is in his 30s. The reports said he was expected to be released without charge later today while a file on the matter is prepared for the DPP."

10. Concealed gun law causes stir in Ohio (IN)
"'Pass it, and they will come.'
That has been the response from Ohioans seeking to complete the required firearm training so they can obtain a license to carry a concealed handgun under legislation passed in January.
The law will take effect Thursday.
One stipulation requires applicants to take 12 hours of firearm safety classes from a licensed instructor or otherwise produce valid documentation of prior firearm training before a permit will be issued. Another stipulation allows businesses to bar firearms from their premises.
Phil Wells, Paulding County resident and certified instructor, said he had to temporarily stop advertising his class because the response was so immense.
'We couldn't eat supper. The phone would be ringing off the hook,'" he said. 'They'd call when you went to bed. You'd wake up and have three or four messages.'"

11. House OKs concealed-gun bill, sends it on to Sebelius (KS)
"TOPEKA - Legislation allowing Kansans to carry concealed handguns cleared the House on Thursday and went to Gov. Kathleen Sebelius, who has said she won't sign the bill in its current form.
The measure would require the attorney general's office to issue a concealed-carry permit to any Kansan 21 or older who is a U.S. citizen, pays a $150 application fee, has no mental illness or drug or alcohol addiction and completes eight hours of training.
As amended by the Senate last week and passed by the House on a 78-46 vote Thursday, the bill would allow concealed guns in the Statehouse, school parking lots and restaurants that serve alcohol. Many other venues would be off-limits.
Sebelius has said repeatedly that she supports allowing concealed-carry only for retired law enforcement officers."

12. Guns Are Safe for Family (Letter to the Editor, FL)
This letter is in response to "Guns in Family Setting" by Harlin Kreplick . Once again we have an individual using a tragedy to promote his own misguided political agenda. Mr. Kreplick seems to make an argument that by having the gun on a camping trip that this somehow caused the tragic suicide.
Well, I am a responsible gun owner and I have two small children. I am welltrained in its use.
My children are aware of guns, know how they operate, and how they can be safely owned and used. If I were on a camping trip, I would most definitely have a weapon on my person. As my home is administered, so would my campsite.
The gun would be under my control and if not under my direct control, locked in such a way as to make it impossible for any other person to gain control over it. You see, the purpose is to protect my person and my family, and that is my right. It is a right that, at the moment, I have in this country.

13. Authorities suspected man accused of killing deputy had guns (NC)
"ASHEVILLE, N.C. - Buncombe County deputies suspected that the man accused of killing a fellow deputy and then himself had guns inside his house when they went to deliver involuntary commitment papers.
The sheriff's department sent three deputies to deliver the papers in case there was trouble taking Eddie Cassada into custody Sunday night.
Sheriff Bobby Medford said Cassada's wife sought the involuntary commitment papers earlier in the day. He said he didn't know what prompted her request that deputies bring him in for a mental evaluation.
Cassada, 56, fired at officers as they approached the house, killing Sgt. Jeff Hewitt. He was the first Buncombe deputy to die on duty since 1974, when auxiliary deputy Ervin Penland died in a wreck while chasing a suspect, according to the state Department of Justice..."

I don't disagree that efforts need to be made toward harm reduction in some cases where the activity that involves the risk of harm cannot be prevented.

Contraceptive education is a prime example. We just can't either keep kids away from sex, or persuade them to stay away from it themselves.

One question is: at what point does a supposedly harm-reductive measure become more likely to encourage the potentially harmful activity?

For sex, it seems to be highly unlikely that teaching children about safer sex is going to encourage them to engage in sexual activity. On the other hand, we know very well that instructing them not to engage in sexual activity just plain doesn't work. Harm reduction seems to call for instruction in safer ways of doing it.

For firearms? Harm reduction does call, first and foremost, for keeping kids away from guns and guns away from kids. That's too obvious. And there *are* things that can be done to that end, that can't be done in the case of sex, obviously.

Does it make sense to teach kids how to play with firearms safely when there are no adults around? No more bloody sense than it makes to teach kids to play with snow blowers or circular saws or pesticides or alcohol "safely" when there are no adults around.

It simply is not safe for kids to play with those things with no adults around. The enormity of the harm that could result is simply too great. Maybe we could make kids "99%" capable of playing safely with firearms or snow blowers -- but the 1% risk simply is not worth taking.

It just isn't like staircases, is it? Children cannot avoid staircases; they need to know how to use them safely, to reduce the risks of harm. What earthly need is there for children to need to know how to play with firearms?

To tell children that there is a safe way to play with firearms, or snowblowers, or circular saws, with no adults present, is intolerably irresponsible.

What children need to be taught is simply do not touch firearms, or pesticides, or snowblowers, when there is no adult supervision.

Some children will undoubtedly do it anyway, because some criminally irresponsible adults will allow them unsupervised access to firearms, or pesticides, or snowblowers. Perhaps, indeed, we should include basic instructions like never point a firearm at anyone. Or never look into the barrel of a firearm. Or never put your finger on the trigger on a firearm.

I'm just damned if I can figure out what else a kid needs to know about "firearms safety". Children with firearms and without adult supervision are not safe. Period. By the inherent nature of children and firearms.

Swimming pools indeed. Do you seriously think that children should be taught how to use swimming pools "safely" when there are no adults present?? I'm afraid that to me, the inherent and horrible risks just outweigh any value there might be in that.

Yup, it's a good idea for a kid to know how to tread water, in case s/he jumps or falls into a swimming pool when there are no adults present. I just can't think of an equivalent when it comes to firearms. In case a kid picks up a firearm, or somebody hands a kid a firearm, when there are no adults present, it's a good idea to ... PUT IT DOWN.

I agree with it completely and have said many times long before you showed up that there is no such thing as an accidental discharge. The anti gun types believe the answer to "accidental" gun discharges is to pack on more safetys.

"LEOMINSTER -- The police department wants to replace their 11-year-old .40-caliber Berettas with 80 new .357-caliber Sig Sauer pistols, said Leominster Police Department Capt. Thomas Bisol.
The standard issue Berettas, which officers have used since 1993, have worn down and are falling apart, Bisol said.
'It's a safety concern, especially for the officers," Bisol said. "If something did happen and we knew the guns were showing fatigue we'd feel terrible.'
It would cost $26,500 to pay for the new .357-caliber pistols, Bisol said."

17. Woman accused of killing husband (KS)
"Jay Kruger "loved his wife more than anybody I've ever known," says his boss and neighbor, Jay Jones.
Kruger, 47, would e-mail his wife, Carla, from work several times a day.
They both loved to hunt, and that was part of their bond, Jones said.
But police say that late Sunday night Carla Kruger fatally wounded her husband with a shotgun at their home, in the 300 block of South Floyd, near Maple and Ridge Road. The home is in a neighborhood of manicured lawns and well-maintained 1950s ranch homes.
Kruger, operations manager for Celebrations Fun Equipment, was pronounced dead early Monday at Via Christi Regional Medical Center-St. Francis Campus."

"A bill passed by the state Legislature that allows gun dealers to open shops in their homes has some local officials up in arms.
'How could anybody in their right mind think it was appropriate for a gun shop to open up in a neighborhood?' said Bellevue City Councilman Tom Ratterman.
The legislation, which exempts gun businesses from most zoning laws, sailed through both houses of the General Assembly last week, passing by a 77-17 vote in the House and a 34-4 margin in the Senate.
Sen. Katie Stine, R-Fort Thomas, one of the bill's co-sponsors, said the legislation strengthens an earlier law, passed in 1984, which prohibits municipalities from regulating the transfer, possession or manufacture of firearms.
'This is a Second Amendment right that the legislature felt was very important,' Stine said."

A San Diego County task force on domestic violence wants to put some muscle behind laws that require abusers to give up their registered firearms.
People convicted of domestic violence crimes and those who have restraining orders placed against them are supposed to give up their guns.
But there is no uniform, comprehensive system in place to make sure that occurs, said Patrick McGrath, a San Diego County deputy district attorney.
"A guy who broke his wife's nose is not a good candidate to own a gun," said McGrath, the co-chairman of the San Diego County Domestic Violence Fatality Review Team.
In a report that will be formally released Monday, the team offered a list of recommendations, all focusing on getting firearms out of the hands of people who have a history of domestic violence.

20. Pregnant woman shoots her estranged boyfriend(AZ)
PHOENIX - A pregnant 35-year-old woman shot her estranged boyfriend Sunday morning after he reportedly forced his way into her apartment.

Jennifer Sue Manley told police that Bryant Christopher Watkins, 31, was threatening her from outside the apartment in the 17200 block of North 19th Avenue about 5:45 a.m., Phoenix Sgt. Bill Wren said. Watkins told Manley he would hurt her and their unborn child, Wren said.

Manley is nine months pregnant, and three children - ages 4 and 5, and her nephew, whose age is unknown - were in the apartment at the time.

She feared for her life and the children's safety, Wren said.

21. Two arrested after shooting school bus with BB guns (OH)
"A bus full of Unioto elementary students got a scare Thursday afternoon when two teen-agers with BB guns allegedly shot out windows of a school bus.
Nobody was hurt in the shooting, which occurred as Bus 10D was making its afternoon rounds.
The Ross County Sheriff's Office took custody of two 16-year-old boys believed to be responsible for the shooting. They were released to their parents, and though they've not been formally charged pending the opinion one of the county's prosecutors, the sheriff's office is looking at one charge each of criminal damaging and endangerment, Lt. Dennis McKeever said
Driver Jodi Scott said there were more than 60 children on the bus --ranging from kindergarten to sixth grade -- when it was first hit while traveling through Kenowa Village Trailer Park."

Investigators said Robert Trott, 56, called 911 at about 6 a.m. Tuesday and said that he shot a man who had attempted to break into his home on Hillcrest Street.
Later, detectives determined that the victim was Trott's 36-year-old son, Robert Jr., according to Local 6 News. However, authorities are still not sure whether the shooting was accidental or intentional.
After four hours of questioning Trott, Smith said they found holes in the homeowner's story.
Trott's attorney advised him to stop answering questions Tuesday night, Local 6 News reported. "

29. Teen Shot In Head While Watching TV (FL)
"A 16-year-old in Orange County, Fla., is in critical condition Tuesday after being shot in the head while watching television with other teens, according to Local 6 News.
Investigators are still learning the details, but said four teenagers, ages 15 to 17, were watching television in a house located off Buena Vista Avenue when a gun fired.
When officers arrived at the house they found Durrell Curry, 16, shot in the head.
Detectives are not sure who the gun belongs to or how the teens gained access to the weapon. Local 6 News reported that the shooting may be accidental. "

"An argument over a cigarette lighter ended with one man accused of killing his cousin.
Joe Nathan Miller, 24, of Sumter has been charged with murder in the shooting death of Jimmy Terell Johnson, 20, of Bishopville, said Maj. Perry Herod of the Sumter Police Department.
Johnson was discovered early Sunday morning by officers in the back seat of a white Dodge Stratus with its engine running outside his cousin's home. Investigators think Johnson was trying to leave when he collapsed in the car, Herod said.
He died that day at Tuomey Regional Medical Center of a single gunshot would to the chest."

"Police are investigating an early-morning shooting at a northeast Denver home that left a man dead. A suspect is at large.
Police were called to a home in the 3600 block of Kearney Street a few minutes after midnight today on the report of a shooting, spokeswoman Det. Virginia Lopez said in a statement. There they found James Nunley, 22, with a gunshot wound to the chest.
Nunley was taken to Denver Health Medical Center, where he was pronounced dead at 1:05 a.m."

Police say Kevin Wilkins went to answer a knock at the door of his girlfriend's house around 10:30 p.m. Monday and was shot to death.
Authorities say Wilkins' girlfriend was in another room with her son at the time."
