1. ohio?
It's 1:30 in the bloody morning, WTF are courts doing in session. I guess the thugs are night people. Good grief, a supreme court appeal on election day about electoral procedure. The federal court is insane, they have no business messing with Ohio state laws.

I thought the state court said that party recruited poll watchers could not be in polling places in ohio, and the republicans were going to appeal that. why are you saying dems are going to appeal?

21. Fed Courts are loaded with Republican thugs

I can't believe they will allow voters to be challenged at the polling places. This is disgusting. It's intimidation.

5. Look, the Republicans know how easy it is to .....
........steal an election.

I'm glad the Democrats' lawyers are going after this one. And, yes, you can run appeals - exigent circumstances - at all hours of the day and night.

Just gotta keep hammering at them.......

God bless you all for fighting for our country at the polling places tomorrow. Truly, a defeat for the President is a victory for terrorists all over the world who will trumpet his repudiation by the US voter. We cannot allow fraudulent voting to win the victory for our enemies. So thank you all very much, all of you volunteer poll workers in the contested states. May you be wise, alert, and courageous in stemming the tide of corruption that would steal this election from Pres. Bush by the traitors of this country.

11. WRONG! Step away from the Fox News!
The Sixth Circuit has not ruled.

The Ohio Supreme Court has ruled, but the Federal District courts trump it.

http://www.wcpo.com/news/2004/local/11/01/blackwell_annc.html

<snip>
There will be no partisan challengers allowed inside Ohio polling places on Election Day, according to an announcement made by Ohio Secretary of State Ken Blackwell Monday night.

Earlier on Monday two federal judges barred Republican party representatives from challenging the eligibility of voters at the polls.

The GOP filed an appeal with a federal appeals court. That ruling is still pending.

"Unless the Sixth Circuit Court of Appeals overrules those two federal rulings overnight," said Blackwell in his announcement Monday night. "Our instruction to Ohio poll workers remains unchanged."

the lower federal courts orders barring the challengers.

24. Ok, so we just back up to yesterdays plan
The RNC sent some of those assholes to Florida already. They will challenge some people. Pull them aside and tie them up as much as possible (citizens arrest maybe?) They will not have time to challenge everyone. And maybe time for another appeal too (for the supreme court, with a sick justice, sheesh)

16. Cincinnati Enquirer Link here; good reporting and background info
http://www.enquirer.com/midday/11/1102chall.html

A federal appeals court cleared the way early today for Republicans and Democrats to challenge the legitimacy of voters before they cast ballots in today's election.

A panel of the U.S. 6th Circuit Court of Appeals voted 2-1 to allow the party-affiliated challengers in polling places today, overturning two lower court rulings in Cincinnati and Akron.

The decision was immediately appealed to the U.S. Supreme Court. But if the ruling stands, Ohio voters can expect to find challengers in thousands of precincts across the state.

19. Just get the camera people there!!!!
Appeal to the Supreme Court? What a waste of time an energy that will be.

Someone should quick assemble and army of Michael Moore's to get to the polling places with cameras to capture exactly what the GOP is trying to do. Get them on film challenging someone vote. Get the camera right in their face and force them to look at the world and say that they are trying to STOP someone from having the right to vote.

Moore is on the ground in Florida, surely there are young aspiring filmmakers with cameras in Ohio who can stake out the polls!!!

25. Guess who the justices were.
Senior Judge James L. Ryan, appointed October 17, 1985

http://www2.pcanews.com/world_life/stories/story522.html (dissenting opinion holding that that school vouchers to religious schools are Constitutional because they fund religious organizations)

http://216.109.117.135/search/cache?p=%22james+l.+ryan%22+judge&ei=UTF-8&fl=0&u=www2.uclick.com/client/ven/jk/&w=%22james+l+ryan%22+judge&d=348B3AB4D0&icp=1&.intl=us(dissenting opinion stating that there's no Constitutional reason why the Ten Commandments can't be displayed at schools and courthouses) And please forgive the huge hyperlink.

This particular court is actually pretty fucked up. I'm fairly ignorant of the Federal courts, but I've been pretty shocked at the press this particular court has been getting for its partisanship and internal strife.

28. 3 Appeals judges: 1 appointed by * in 2002; 1 by Reagan; one by Clinton
And thus, the 2-1 vote in this case.

This is why there's been all the ranting here on DU about the damned GOP judicial appointments!!!!!

26. This is going to be fun to watch
Four years ago the Supes ruled that federal law trumped my states rights (FL) when it came to the election. Now the federal appeals court in Ohio has concurred: federal rights supercede states rights with regard to elections.
This ruling better be overturned and it had better be consistent or there is going to be hell to pay.

My mantra for the rest of this election remains: "Bring it On!"

29. STEVENS presides over this circuit.
Yup - JOHN PAUL STEVENS.

He has the power all by himself to stop these challenges if he wants.

Watch - he'll issue a reversal/stay of this decision first thing this morning, which will STOP challenges from taking place. Don't think for one moment that he hasn't foreseen or been warned about this.. he's ready!

And the brilliant thing.. the next step would be the final appeal - to the US Supreme Court. And we know that this would take too long to reverse Stevens' orders..
