for *'s plan to curb class-action lawsuits???

The fact of the matter is, we have a bunch of effing phonies sitting in Congress who are Dems in name only. Had they stuck together and voted NO on this outrageous legislation, it would have lost.

Those people (those who voted for it, I mean) don't represent us-- they're effing Repugs!!!!

It's easy enough to find out who voted YES...

I hope those of you who have reps who went along with this draconian legislation give them bloody hell.

My guy in the Kansas 3rd district, Dennis Moore, voted for this trainwreck. I'm somewhat disappointed in him for this and other votes, but I recognize that the alternative is far worse. By swaying to the right on some issues, he's able to keep his seat in a very red state in our hands. If he sided with Rep. Kucinich on every issue, he'd get booted and KS-3 would be held by a far right theocrat knuckledragger.

I'm not saying I want our national party leadership to pander to the ex-urbs of Kansas City, because that would really piss me off too. I just firmly believe that we need to allow for regionally diversity within the party.

Get real guys. People can still bring individual suits and securities class actions. It's just the state court plaintiffs bar that now loses their big fees.

A valid example would be the Vioxx claims -- or a future claim similar.

My guess unless its a horrendous suit a Federal judge will tell everyone to get lost and quit wasting valuable Federal time.

Not all class action suits are the "big news" stuff like drug companies and exploding Pinto's. Many can be as simple as getting screwed over on a $2,000.00 computer that never worked as advertised. It could be a defective riding mower or many other things. None possibly caused you bodily harm,just caused harm to your check book.

Think a Federal Judge will let those "frivilous" suits come to fuition?? My guess is most likely HELL NO.

Bararck Obama's Yes Vote

Barack Obama (D-Illinois), a new US Senator, was interviewed by phone on "The Al Franken Show" radio broadcast today.

Radio co-host Katherine Lanpher asked Obama about his vote in favor of this bill.

Obama replied that he supported it because he doesn't want plaintiffs going to whatever state has the most sympathetic state judges.

(My response: Instead, injured people are now likely to face unsympathetic Bush-appointed federal judges.)

Obama also said that he doesn't want people suing the the Starbucks restaurant chain over lukewarm coffee and getting coupons.

(My response: The bill restricts attorney fees when the plaintiffs are awarded in coupons.
Whether or not the coupons aspect of the bill has merit, it certainly doesn't justify voting for the bill as a whole.

I assume the reference to Starbucks was hypothetical. If there was an actual lawsuit against Starbucks, please post in the comments about it.)

Al Franken and Katherine Lanpher didn't say whether they agree or disagree with Obama's vote during the interview.

Near the end of the interview, Al Franken implied that Barack Obama should be the Democratic nominee for president in 2008. Al Franken said, "Obama/Sptizer 2008" (referring to Eliot Spitzer.)

I don't want Barack Obama to be the Democratic Party's presidential nominee.

A person's position on "tort reform" says a lot about whether he's on the side of corporations or the people.

For 2008, I'd prefer John Edwards, who is on the side of the people.

It is a betrayal of everything, absolutely everything. I think many of them are in denial, and not quite getting it. Read DU before you vote!

It is so stunningly simple, yet it works every time.

In order to destroy plaintiffs rights, start with something simple, "non-threatening", easy to vote for.

You know, say things like "this has no effect on REAL people with REAL problems - we're just trying to get rid of frivolous lawsuits."

This will get many spineless Dems on board, fearing of course they will be painted by the Limbaugh brush if they don't play nice.

But don't worry, I say, this has nothing in common with a similar tactic currently being used with great effectiveness in the halls of Congress as we speak.

"Partial birth" abortion, I believe it's called. This, as you know, has NOTHING to do with eliminating a woman's right to choose - "we're just trying to get rid of a very bad and dangerous practice."

However, I am contacting DNC and letting them know I will not donate to the party if the Democrats in power go along with Bush's radical proposals.

I love my senators though. Both voted against it (Levin and Stabenaw).

I'm also pleasantly surprised by Hillary. Reid's been doing better than Daschle as well - nice to see him vote against this crap legislation.

I wrote our new senator a note--reminded him how Senator (Please everybody in both parties and hang with the big guys) Dixon was BOOTED out of office, and Carol Moseley Braun put in his place, when prevailing wisdom was that Dixon was "immovable." I also referred to my other big campaign, electing Paul Simon to the Senate in a four way primary, and against Repub money in the Reagan years.

I warned him that if he loses his Democratic base, he will find a ferocious battle on his hands.

Jesse Jr voted with the good guys anyway.
