2. You can relax (a little)
The bill moves to the House next month. Under the fastest scenario, it wouldn't be signed into law until sometime in mid-April to early May.

Once it has been signed, the old laws remain in effect for 180 days. So, you would have, under the worst case, until sometime around October to file under current law.

BTW, here's a site you might want to visit. Check out the bankruptcy forum; it's full of good posts and info.

Peace.

7. The effective date is in the bill - 180 days after it is signed into law.
Having passed the Senate on March 10, the bill now goes to the House, which will vote on it in April. There will be no retroactive provisions; no amendments to that effect were added to the bill before passage. The bill's supporters would not risk facing a constitutional test in court that might kill the whole bill if such a draconian amendment were tacked on. They also know there'd be huge PR fallout.

Just a thought: scaring people needlessly here is not helpful. Reality is scary enough. The original poster is clearly worried about the time frame. Six months is tight but more than adequate if it becomes necessary to file under the old law.

Peace.

8. what can be scarier than Bush and his evil plans?
I still say that there is no way everyone who needs to will be able to claim bankruptcy before the new deal. There will be a legitimate stall because of the what will most likely be Huge traffic in applications, or the weasels at the helms will slow applications down by saying this is so, whether the claims are handleable or not.
