Will the Schiavo case make it to the SCOTUS?

Will the Schiavo case make it to the SCOTUS?
And if it does won't the court rule for the right to die? I'm assuming that a court that up holds Roe 6-3 will not violate states rights over this. So why should Dems waste political capitol over this?

4. either they have to piss off the religious hysterics
or they have to declare the judiciary branch of the government to be totally irrelevant.

This is a separation of powers issue as well as a states' rights issue.

Because the alternatives are unpalatable, they want to stay out of it. They don't realize that the Republithugs have developed such a total contempt for law and for constitution that similiar cases will keep coming up until and unless they slap Bush and the GOP Congress down HARD.

Let's hope they find the courage.

7. That is why they are passing the bill
they made it a law now. So its at least has to go to federal court and then work up the chain to find out if the law is constitutional. So it will probably end up in the Supreme COurt sooner or later.

2. They violated states rights on 12-12-2000
Specifically preventing the vote count in Florida in order to deliberately throw the election to the Chimp.

One would think that Billy Rehnquist might be thinking about medical situations, death with dignity and all that, given his current state of health. Maybe they should let him cast the deciding vote?

5. They already tried the SCOTUS via the normal measures
The SCOTUS blew it off and handed it back down to the original court, which subsequently ruled for like the nineteenth time.

Now the religiously insane are demanding a do-over.

jurisdiction, i.e. there was no "federal question" to be ruled on. Now, the scum-sucking repukes in congress are trying to grant such jurisdictional authority, as they can constitutionally do. Even if the federal courts may take the issue on advisement, however, they can still look at the overwhelming precedent of states being the domain of family law, and toss it right back to where we are. In the meantime, as the case may ultimately be appealed up the latter to SCOTUS, the feeding tube remains against Terri's wishes.

Sickening act of political grandstanding, huh?
