Were the RW actions this week, just the latest anti-Judges scam?
I just heard a very ANGRY "Congressional Activist" Rep. Steve King (R-IA) interviewed on "Weekend - All Things Considered," were he seemed to tip the Rethugs hand, saying that if the Judges and the Federal Courts are just going to "Ignore" the actions of "The Congress" when they pass a Law, "The Congress" will have no choice other than using it's constitutional powers to "rein in the courts."

He suggested that they will start cutting the funding for the Federal courts, or even start eliminating them, because "the U.S. Constitution only established the U.S. Supreme Court, all the rest were created by Congress." This guy is truly a lunatic.:crazy:

For all of you, who are thinking NPR is becoming a mouth piece for the Right, they did immediately follow up this interview with a left wing counter argument by Seth Stern a reporter for "Congressional Quarterly."

Though I don't think it was unexpected, this is the first time I've heard any Repuke verbalize this tactic (he was clearly in Full-Spin Mode), and I think this is what's coming in the next few weeks.

1. Christ, I'm a HS student,
and even I know that the judicial branch has every right to "ignore the Congress" if they feel a law is unconstitutional.

How do these people get into positions of power?

He is on the Judiciary Committee

This article refers to him as an embarassment. It was published in Sept 2004 and he was re-elected anyway

4. This is an organized campaign to do away with judicial power

Whenever the wingers want to work something, the start off with their framing phrase. The code words this time are "judicial tyranny." Lots of different RW propagandists are using that phrase, and identical arguments. One is, "Why should unelected judges have the last word?" They are also repeating RW myths about judges being liberal. There are lies that the Supreme Court is deciding cases based on foreign law. They are using any lie they can think of. The wingers aren't trying to undo Roe v Wade anymore. They are trying to undo Marbury v Madison.

The winger propaganda is accompanied by calls for Congress to take away the jurisdiction of the federal bench, hence the power of the judicial branch overturn the Congress. The threat isn't being taken as seriously as it should be. Most people don't believe Congress can do away with the jurisdiction of the courts. Under Article III section 2 of the constitution, Congress can do just that, and with a simple majority vote, except where the Supreme Court has original jurisdiction. Findlaw has a long list of cases that were decided by the courts in favor of Congressional power to do this. Its been done many times before. I don't think they've ever tried to do away with all judicial power before though.

The wingers have been saying for a couple of months now that the executive branch doesn't have to obey the courts. The calls for the executive branch to intervene in the Schiavo case are based on this propaganda. Its not just a few wingers that believe it. Most of them are already trained.

I take this threat very seriously, and consider this part of their efforts to make America a Fascist nation.
