I just heard a caller on Randi Rhodes say this. What if it were this simple!

is that you can't filibuster rule changes, only bills.

7. You can not filibuster procedural vote
The nuclear option is a pure procedure vote that is not subject to the filibuster. There are a couple of types of votes that are expressly not subject to a filibuster under senate rules including votes on tax measurers and procedural rulings.
