Can Karl Rove be indicted without Judith Miller testifying?
I know - none of us know what it is Miller knows and who she is protecting. But she will not testify, and I believe that she holds the key to the entire case against Rove. In three months, she'll be released from prison, and that will be the end of that.

1. Rove is toast already for identifying an agent
even if Miller doesn't testify. My guess is if Fitz doesn't wait for her to change her mind, she will be charged with obstructing justice and have to answer to that charge. Maybe that might give her pause for thought.

Rove is already going down for perjury/obstruction of justice due to lies in his testimony.

with or with out the cooperation of Miller.

4. I think, in her case, it's less about Rove and more about someone else.
But only Fitzgerald knows for sure, I guess.

5. That baloney about not knowing which journalist told him about
Plame has been exposed. The NYT has just issued an article which details a memo sent to Powell while he was traveling with Bush which names Plame as an agent.

he may have perjured himself before the grand jury. (He's been asked to give testimony on 3 different occasions which may indicate that some questions were repeated to him after others gave their testimony)It may be that there is a clear cut way Fitzgerald has to show that Rove passed the information about Plame and her CIA undercover status on to other mouthpieces which would fit him for either an IPA or Espionage Act charge, depending on the details. Certainly Novak's testimony would be that Rove confirmed for him her covert identity which places Rove in jail depending which bloated gasbag the jury believes is lying. In three months this will STILL be ongoing as a trial or trials and maybe there will even be additional investigations. Miller can be cited for contempt again and again particularly if something is learned that makes HER a target of the grand jury investigation. She has no confidentiality privilege to lean on so all she can do now is take the 5th or enjoy another contempt of court citation. Will Fitzgerald let her go for lack of evidence? Nobody knows what he has or what he'll do, but think of the years Susan McDougal spent in prison doing contempt of court stints before Ken Starr finally struck his tent. Will Miller learn to love life inside?

Could Traitor Bushco be using Miller as insurance? Is Miller a necessary witness in Rove's case?
