Mark my words, Roe vs. Wade will not be overturned...
Does anyone really think * would nominate someone who would overturn Roe vs. Wade? It'll never happen. Not with this administration or any other repuke administration that follows. It's their only issue. It's the only "sure thing" they've got to fire up their base.

If they "win" the abortion issue, what to they go to the next election cycle with? Nothing! School prayer? Please! No one really gives a shit. Assisted suicide? Yeah right! Not "hot" enough. Tax cuts? SNORE! Even their base sees through that one. The ones that know enough, realize we're spending more than any other admin in history. Those that don't know, wouldn't underfuckingstand it anyway.

Nope. Abortion is way too easy for them. Do you really think they're gonna give it up? Do you think they give a fuck if some single black woman in some podunk town aborts a baby? Do you really think they give a fuck about that fetus. It's BLACK for christ's sake!!! They care about the issue, but only politically. It works for them. It helps them get into office on the backs of backward rubes who think abortion is a national fucking issue. It's the food on their table!!! Don't think for a second they're gonna get rid of it.

Can I get an AMEN???

It seems to me that after screaming and hollering about it for decades, the apple might be ripe for the plucking. The issue has been inflated to such central importance in the minds of most Republicans that whoever accomplished it would be a great hero. Sure, it might screw later candidates out of a wedge issue, but since when have Republicans been unwilling to give the next guy the short end of the stick?

16. I think you are right about the people that would want to change it....
but you will find they are consecutively out of power and labeled as nut-bar if they get to high up.

It is the perfect wedge issue to give the Bozo's the 30% evangelical vote every time.

Losing this issue is the death of the repukes, plain simple.

Abortion is also a global issue. The world will be for choice, just like the overwhelming majority of Americans. I agree with your line of reasoning and if the SC interprets it differently, the people will cite their beliefs and the world view, and will then amend the Constitution to settle the political nature of the interpretation.

It means that Roberts will be a liar in his "settled law" statement. I only want to hear the question of "settled law" on abortion put before Miers.

4. Not only that, if abortion became a legislative issue again, the Repugs
would become a minority party if they uniformly called for it to be outlawed as the fundies want. If the business wing showed their true colors and argued for some extent of legalization, the party would fracture. It's a lose/lose for them if it is overturned.

voters divided while they gain more power and wealth.

SCOTUS' caseload is more than 7,000 cases per term and plenary review, with oral arguments by attorneys, is granted in about 100 cases per term. Formal written opinions are delivered in 80–90 cases. Approximately 50–60 additional cases are disposed of without granting plenary review.

My guess is SCOTUS will just refuse to hear a case and leave it in limbo as a divisive political issue.

What can voters do when SCOTUS has lifetime appointments?

Roe v Wade = tons of $$$$ for Repugs

Roe v Wade = lots of foot soldiers at election time..

That one single issue means too much to the leaders of the Repug party for it to go away.

Stare decisis, let the decision stand, seems to be especially important for the Supreme Court.

The entire nature of the court isn't supposed to change with new justices.

Plus I can't imagine the outrage, and the back alley dangerous procedures that would return.

And I do also believe there is something to the argument that the Repugs like to keep this alive, like a festering wound that they can keep picking at and pointing to. To galvanize their base.

They'll just whittle it down to the point that it will be a practical impossibility for many women to get an abortion, while still having enough of it around to keep their base perpetually riled up.

They're going to have their cake and eat it too on this one, is what I'm afraid of.

Hypothetically:
Roe V Wade overturned, abortion is illegal.
And a story explodes all over the papers that Jenna had an abortion paid for by daddy.
Splat.

(realistically, Jenna would be sent to a private clinic to Geneva to be treated for "exhaustion", but the rumors would be just as damaging for daddy)

but remember the SCOTUS only rules on cases that are brought before them so unless a specific case comes up that would overturn Roe then what will happen is a chipping away at choice - first parental notification, then partial birth, then something else and so on.

Roe is not the only law on the RW agenda. Gay rights, civil rights, right to die, evolution, prayer in schools.

Miers will vote to overturn every choice case that is brought before the court. She will because her fundy beliefs are more important than the Constitution.

TO say that Roe is an issue the Repugs don't want to lose is denying the RW agenda. They DO want to overturn Roe. This isn't some political game with them. Bush may not personally care but he does want a legacy and if overtruning Roe will give him perks with the base and a legacy with the base he will take it.

All of his speeches about Miers have been a "wink wink, nod nod, you know what I mean" to his base. He's saying trust me on this one. I know what I am doing.

He is also getting his corporate appeaser on the court, which is probably just as important to him.

A principal in preparation for dispute or battle is simple, Sun Tzu teaches that you prepare for what they CAN do, not what you think they WILL do. The lesson there is obvious, if you guess wrong, you lose in a very big way.

If we are wrong, we lose Roe V. Wade to the States. California, New York, and a few others will keep Abortion without restrictions, some states will have a few restrictions. A few states, we all know which ones, will ban it outright. Will we all be here, on this message board, all typing the same thing? Will we be typing "I can't believe they did it"?

What worries me is this. If our leaders are unwilling to fight for this out of fear of losing a seat to the Repugnik spin, how much fight will there be for a National Ban going through Congress? Will we decide it's smarter to lose that fight, and campaign on the issue later?

It's easy to say "this isn't worth it, we must wait until later to fight" when faced with difficult issues or situations. You take a step back, and another step, and before long, you find you aren't able to retreat anymore, and the enemy has gotten so strong you can't ever beat it.

We are in a perilous situation, make no mistake about it, if you are right, and the Repugniks won't risk losing the issue, we still risk alienating our own members. If you are wrong, and that is just as likely, we will suffer a setback that will take decades to recover from.

This isn't a poker game, we aren't only losing a big pile of chips if we are wrong, and the Repugniks aren't bluffing. We are losing another right.

How many rights are we going to sacrifice at the alter of Political Power? We have already tossed CAFTA, Bankruptcy, Search Warrants, and Goddess only knows how many I am not thinking of at the moment. You all can add to the list, probably more completely than I can.

We all wait for the leaders we know and support to stand up and say "This is wrong, we are hurting regular people, working families". We wait, and hear the same thing. "It's not time yet, we must wait, let them get this little win, and we will have them".

When will it be time? When will it be time to stand up and say No more? When will it be time to draw the line? I sincerely hope it is before we sacrifice the 1st Amendment to the alter of Political Party Power. I hope we don't get it wrong.
