Let's look one step ahead if Miers does withdraw her name....
No doubt Bush would be forced to up a right-wing nutcase. That's the only thing that would satisfy the cannibals. What should the Democrats do in that case? I would say they should tell Mr. Bush right up front that it better be someone that America can accept - not just the right-wing of America. If he doesn't do that, be ready for the filibuster. Force their hand.

i wonder if the plan all along was for her to go down.
shrub then unveils the "real" nominee, someone who would have been unpalatable as a first choice.

it's a lot harder for the senate to shoot down two in a row. the "defer to the president" argument holds a lot of appeal to senators, because so many of them think they'll be president someday.

incompetence. They never, in their wildest dreams thought the Repubs would be the ones to shoot her down. But, you are probably correct. They already have the justice of their choice in the wings.

Then the matches get passed to the Dems and it's filibuster time. Janice Rogers Brown is waiting in the wings. I wouldn't be surpised if Miers thought this up or at least voted for the concept of her, Miers, being a throw away nomination.

Democrats will filibuster, Republicans will go nuclear, the filibuster will be destroyed, and the nominee will be confirmed 51-49 or so.

Bush will then nominate some REALLY scary people to the lower courts and cram them through since we have no way to stop. Republicans will catch hell for their power grab and will lose 3 senate seats and a dozen house seats in 2006.
