Forrester won't be charged, state says

The Attorney General's Office did not say if his campaign contributions were proper. But it decided not to prosecute.

With New Jersey's gubernatorial election less than two weeks away, the state Attorney General's Office yesterday declined to say whether Republican Douglas Forrester had violated a campaign-spending law but decided not to prosecute him.

In a letter to Forrester's attorney, the Attorney General's Office said that bringing charges against Forrester for past conduct was "not appropriate."

The letter said the state had made no finding on whether Forrester's contributions to his campaign and to other Republicans were proper.

"We have determined that criminal prosecution is not appropriate," Ronald Susswein, deputy director of the Division of Criminal Justice, said in the letter. He added, "The discretion to decline criminal prosecution does not constitute a finding by this office that corporations and majority shareholders of those corporations are not covered" by the campaign spending statute.

A campaign director for Corzine, Steve DeMicco, said the attorney general "has put Mr. Forrester on notice" that he may be prosecuted if he continues making the contributions in the future.

While deciding not to prosecute, Harvey said his office still would review the law, including how it applies to Forrester and his companies, after the Nov. 8 election.
