Once again delay whines and gets what he wants: This time a new judge
Edited on Tue Nov-01-05 07:37 PM by rpannier
In a courtroom victory for Rep. Tom Delay, the judge in the campaign-finance case against the former House Republican leader was removed Tuesday because of his donations to Democratic candidates and causes.
The ruling came after a hearing in which Delay's attorneys argued that state District Judge Bob Perkins' political donations created the appearance of bias. Perkins, a Democrat, has contributed to candidates such as John Kerry and the liberal advocacy group MoveOn.org.

So now...if I'm arrested for assault and the judge donated to a Victim's Rights group then I can demand a different judge? Since, I'm a Democrat I can demand a new judge if the presiding judge is a Republican. This decision is just assanine. People should write and e-mail semi-retired judge C.W. Bud Duncan telling him what an inane decision he made and tell him he should stop being semi and become completely retired.

3. That ruling is so Texas, but maybe DeLay won't like the "sloppy
seconds" judge either.

4. DeLay and his Attorney..........
may have set themselves up for a hit here. There is a close association among Judges, it even defies politics in a majority of cases. By claiming that this Judge was partisan and couldn't rule properly because he donated to Democratic candidates he runs the risk of alienating every Judge in the area. Judges don't like to be "judged" by criminals. This was such a bad decision in so many ways but I still think it could bite him in the ass, at least I'm hoping it does. No one deserves it more than Tom "Bugman" DeLay.

8. The precedent has dizzying possibilities.
Someone needs to bump this dispute thru the higher courts. I hope Earle challenges it.

For one thing, my guess is that the judge has a case for something like libel? It is scurrilous, not to mention income-damaging, to impugn his impartiality this way. I think the judge needs to sue DeLay. Can he?

Let's open a REAL can of worms.
