Sen. Graham Introduces Amendment to End Habeas for Detainees
Breaking: Senator Lindsay Graham is introducing an Amendment to the defense appropriations bill pending in the Senate (S. 1042) that would strip those designated by the Administration as enemy combatants of the ability to seek habeas review in federal courts. This is an end-run around the Supreme Court's decision in Rasul v. Bush which held Guantanamo detainees have the right to challenge the legality of their detentions.

According to Graham's talking points for the bill (which I received by e-mail) his amendment would prohibit detainees from using the court to challenge:

The legality of their detentions
The propriety of returning detainees to their home countries
Adequacy of medical care at Guantanamo
Quality of the food
Speed of mail delivery
Allotment of exercise time and other conditions of confinement
.....
This would effectively end all litigation brought on behalf of the detainees at Guantanamo Bay, as well as any future litigation on behalf of those imprisoned at the CIA secret detention camps. This bill is intended to have retroactive application.

Not to mention blatantly unconstitutional.

Article I, Section. 9. ,Clause 2:

The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.


There is no rebellion or invasion underway.

letter writing campaign. We could send letters to Lindsey and ltte and open and close with "Heil Hitler."

For example,

Dear Sen. Lindsey;
Heil Hitler! Thank you so much for introducing S.1042. It time we quit treating this garbage, these dogs as if they have any human attributes. The safety and security of the Father Land and the purity of the Christian race depends on good patriotic Americans such as yourself being willing to do the dirty work of the glorius American Empire

11. This is to shield the bastards when the new Abu Ghraib pics
come out. Sure, make it retroactive too. We'll never have to account for any of the abuse and criminal acts reported in MSM and the detainees will still be held w/o oversight.

Lindsey Graham should know better. He used to be on the side of the law, but this amendment sure blows up that myth.

Yes, it's a crime against the very soul of the country and an insult to what we're supposed to believe, but the bigger issue is that the premise is ridiculous. To deny ANY due process to people is horribly wrong, but to do so on the sole word of some hereditary nobody who's been shown to be wrong about virtually everything is just plain nuts.

Meanwhile, a native-born American Citizen (Jose Padilla) sits in a Navy Brig being denied contact with attorneys or even the decency of having a charge filed against him. He's been there for THREE AND A HALF YEARS now.

Even if I didn't loathe this entire administration, I wouldn't trust them to get anything right even if they tried.

This is a police state and an aggressive imperial power demanding world domination. How can people stand for this?
