Frist's vote was parliamentary so he could move to recommit. The Republicans will be able to call for a vote again when/if they think they can break the filibuster. But, for now, the Patriot Act is dead!

4. His 'No' vote was a parliamentary ploy.
The prevailing side of any vote can make a motion for reconsideration (which is typically tabled). Since the Senate rules place a time limit on how soon another cloture motion can be made, Frist's ploy technically opens the door for a reconsideration of the 'old' cloture motion sooner than a new motion could be made.
