FISA Court SHOULD resign as worse than useless
All it does is provide Bush with the opportunity to repeat the lies from the campaign trail of 2004, that there are courts reviewing his requests for warrants, don't worry.

Fact is, the only requests for FISA warrants are the ones that the Bush admin knows it will get. When they want to spy on PETA and Sierra Club, they don't ask for warrants and do it anyway.

I suppose every once in a while someone miscalculates and gets turned down. What do you think happens then?

a) "THe court has spoken, we cannot wiretap"

b) "Let's do it anyway and just not tell anyone, Alberto has signed off".

Of course, one has to wonder why our criminal court system hasn't just quit and gone home, given Padilla. And Congress is just a shell of it's former self.

But even Hitler and Stalin maintained the fiction of courts and a representative body. Is it fascism yet?

1. FISA is independent
Without FISA there would probably be no paper trail to inspect. Why do you think Bush wants to circumvent FISA?

I like paper trails.

2. Actually...
...the FISA court has to disband. If they do not know that the evidence presented to them was not obtained from an illegal warrantless search, they can not issue a warrant. This is the exclusionary rule.

In essence, the Bushies have corrupted the well, so no water can be trusted safe to drink.
