I think Delay is Judge-Shopping to Throw Out Case

I have always felt the accusation of "judicial activism" more accurately applies to Republicans who almost always accuse others of precisely what they are doing. Cheney wanted to keep his Energy Commission records secret and although ordered repeatedly to turn them over, he shopped and finally found a "good 'ol boy" who ruled his way. This is Delay's second appeal, but watch this space. I predict he ain't done by a long shot. After all, the Republicans didn't spend all that money installing judges for nothing.

Appeals court deals DeLay a setback
His bid to get the criminal case resolved before primary now rests with another panel

AUSTIN - U.S. Rep. Tom DeLay's hopes of getting his criminal case resolved before the March Republican primary now rests with the Texas 3rd Court of Appeals.

The Court of Criminal Appeals, comprised of Republicans, rejected DeLay's request Monday to either throw out the indictments against him or order an immediate trial on a money-laundering charge. The state's highest criminal court ruled against DeLay, R-Sugar Land, without comment.

Now the quick resolution of his case depends on two sets of appeals before the lower 3rd Court.

DeLay spokesman Kevin Madden blasted Travis County District Attorney Ronnie Earle, saying he has created delays that kept DeLay from going to trial.

"Ronnie Earle has gamed the justice system in Texas in a way that has kept Mr. DeLay's eventual exoneration in a holding pattern," Madden said. "He will eventually be cleared, but it's a terrible thing that Ronnie Earle has sought to deny that full exoneration for as long as possible."

This gives "bug-man" more time to twist in the wind and ponder the fate that awaits him as the Abramoff scandal unfolds all around him. Sweat, little bug-man, sweat! You'll get no sympathy from me, asshole. :nopity:
