Idaho is far more 'R' than Utah. Our state legislature was around 95% Republican at one point (I believe it's down to about 85%). Every state level political office is R, with the exception of the State Superintendent of Public Schools (who coincidently enough is also the only woman in a state political power position). Both Senators and both Representatives are white male Republicans.

In one poll I saw, Idaho and another state (I think a southern state) were the only states with Bush approval ratings above 50%. Idaho's a mixture of rabid religous nuts, anti-UN libertarian quacks, and gun-toting "shoot and ask questions later" NRA boobs. I saw a bumper sticker today that said "If you voted for Kerry you can lick my ass." That sort of sums up the views of a large percentage of Idahoans.

Law comes from all three branches of government. For example, when a judge rules a law unconstitutional it is making law (this otherwise ok law cannot be used). Obviously legislature passes statutes that are either ratified by the executive or passed over veto. Executive branch agencies make regulations that have the power of law (sometimes pursuant to laws passed by the legislature). Plus the president has executive orders which have the force of law.

When a judge rules a law unconstitutional it is NOT making law. No law is put down in the books, no new law springs forth from such a ruling. All that the court is doing is REJECTING a law on Constitutional grounds.

A judge issues an injunction. Violate the injunction and you are in contempt of court and could go to jail. Laws do not only exist in the statute book. They exist in every way the government may coerce your behavior. That is why the published opinions of courts are considered law books - they contain the precedent that is binding on folks.

Also, the common law exists. It is not in a statute book but in common law jurisdictions the laws exist.

Injunctions are A: temporary and B: designed to actually prevent a law or action from taking place, ie retaining the status quo. Again, no new law goes on the books, and being held in contempt is simply the enforcement penalty for violating a law already on the books, the injunction.

As far as common law goes, it is used for historical guidance, mainly in implementing new laws, or judging the merit of new laws in court. As you said, there is nothing on the books, they are more of a guiding opinion.

ie desegregating education in Chicago and other jurisdictions. There are emergency injunctions designed to hold the status quo (and temporary injunctions) while suits are settled. The makers of the Blackberry are currently facing a permanent injunction on using certain technology in a patent case.

I disagree about the common law. Stare decisis means something and trial judges are not free to ignore common law.

I'm not a lawyer, but I've had to read a fair amount of Attorney General opinions, which supposedly hold "great weight," but which are usually the legal equivalent of a letter to Santa Claus. Executors try to define their own powers as broadly as possible. That's why they require checks and balances.

The legislative branch MAKES the law, the judicial branch interprets the law and the executive branch enforces the laws. How on earth can you folks call yourselves a news organization if you can't even pass high school government?
