besides why would any one who thinks watch cnn or any cable news program?

83. Tell me about it!
Idaho is far more 'R' than Utah. Our state legislature was around 95% Republican at one point (I believe it's down to about 85%). Every state level political office is R, with the exception of the State Superintendent of Public Schools (who coincidently enough is also the only woman in a state political power position). Both Senators and both Representatives are white male Republicans.

In one poll I saw, Idaho and another state (I think a southern state) were the only states with Bush approval ratings above 50%. Idaho's a mixture of rabid religous nuts, anti-UN libertarian quacks, and gun-toting "shoot and ask questions later" NRA boobs. I saw a bumper sticker today that said "If you voted for Kerry you can lick my ass." That sort of sums up the views of a large percentage of Idahoans.

30. Well, then, I'd sure like to know
what the fuck constitution he's reading, 'cause it sure as hell ain't ours, that's beyond dispute.

The sad thing is that too many Americans have no idea that that is the case because too many of them don't even know the fucking constitution. NOWHERE in the constitution does it provide for the kind of power grab Bush and his cronies are reaching for. And there is NO SUCH THING as a "unitary executive" legal constitutional theory, NONE WHATSOFUCKING EVER. But what they're counting on is people not knowing that so that they can push this bullshit ever further. We're fucked, people. Really and truly fucked.

And for the record, my former boss and friend, who I still keep in touch with constantly, is an attorney, a conservative who voted for Reagan and Bush. He is absolutely furious and dumbfounded at this, and he's not alone among fellow conservative attorneys. Too bad they didn't realize this shit BEFORE they pulled the lever under Shrub's name.

34. "Unitary executive" theory is ANTI-CONSTITUTIONAL.
It's simple. It's clear. The theory advocates that ALL POWER RESIDES IN THE EXECUTIVE under certain conditions: war and/or opposition to presiding governance.

It's that simple. It's a fucking dictatorship.

WHY THE HELL DON'T PEOPLE GET THAT? This is very seriously challenging times for the survival of what was a country our Founding Fathers sought to create. No,...this is it!!!

We are AT the crossroads of our future, right now. Recommendations to read "romance novels" aren't helpful.

55. Technically correct
Law comes from all three branches of government. For example, when a judge rules a law unconstitutional it is making law (this otherwise ok law cannot be used). Obviously legislature passes statutes that are either ratified by the executive or passed over veto. Executive branch agencies make regulations that have the power of law (sometimes pursuant to laws passed by the legislature). Plus the president has executive orders which have the force of law.

56. Wow, what a twisted interpretation of the Constitution
When a judge rules a law unconstitutional it is NOT making law. No law is put down in the books, no new law springs forth from such a ruling. All that the court is doing is REJECTING a law on Constitutional grounds.

59. OK, how about this
A judge issues an injunction. Violate the injunction and you are in contempt of court and could go to jail. Laws do not only exist in the statute book. They exist in every way the government may coerce your behavior. That is why the published opinions of courts are considered law books - they contain the precedent that is binding on folks.

Also, the common law exists. It is not in a statute book but in common law jurisdictions the laws exist.

62. Sorry, still don't buy it
Injunctions are A: temporary and B: designed to actually prevent a law or action from taking place, ie retaining the status quo. Again, no new law goes on the books, and being held in contempt is simply the enforcement penalty for violating a law already on the books, the injunction.

As far as common law goes, it is used for historical guidance, mainly in implementing new laws, or judging the merit of new laws in court. As you said, there is nothing on the books, they are more of a guiding opinion.

64. Injunctions can be permanent
ie desegregating education in Chicago and other jurisdictions. There are emergency injunctions designed to hold the status quo (and temporary injunctions) while suits are settled. The makers of the Blackberry are currently facing a permanent injunction on using certain technology in a patent case.

I disagree about the common law. Stare decisis means something and trial judges are not free to ignore common law.

You know, we are kinda in a technical argument. We know what bennant meant - the executive can ignore statutes. That is wrong.

66. Yeah, we all know exactly what Bennet means and wants
Unchecked power for the executive branch, ie a dictatorship. Funny thing is that to get such a dictatorship the Bush administration will have to thrown a few big bones to the theocrats in order to get their cooperation. One of those is going to be abortion, of course. Another one might very well be his precious gambling. That would be ironic.

77. Executive Orders created the Rex84 'suspension of the Constitution'
Scroll down a bit at this weblink and read the Executive Orders

http://www.abovetopsecret.com/pages/fema.html

which surely were considered by John Roberts (google up his bio from the WH using 'whitehouse.gov john roberts' :

""From 1982 until 1986, Justice Roberts served in the White House as Associate Counsel to President Ronald Reagan.

His duties in the White House included reviewing bills submitted to the President by the Congress, drafting and reviewing Executive Orders, and generally reviewing the full range of presidential activities for legal problems.""

http://www.whitehouse.gov/infocus/judicialnominees/roberts.html

And doing the same for Samuel Alito we find :

""From 1985-1987, Alito served in the Office of Legal Counsel as Deputy Assistant Attorney General where he provided constitutional advice for the Executive Branch.""

http://www.whitehouse.gov/infocus/judicialnominees/alito.html

So, both men probably reviewed and passed approval upon the Executive Orders creating a 'suspension of the Constitution' and called it...ta dah ! Constitutional to suspend the Constitution, a self-cancelling bit of twisted logic if I ever came across it.

Instead of 'confirmation' I think disbarment, if the documentation ever shows up with their approving these neo-nazi practices, should be considered.

63. America would be a very different place if the executors made the laws.
Building the bridge to the Eighteenth Century....

I'm not a lawyer, but I've had to read a fair amount of Attorney General opinions, which supposedly hold "great weight," but which are usually the legal equivalent of a letter to Santa Claus. Executors try to define their own powers as broadly as possible. That's why they require checks and balances.

65. Let's see, isn't this it?
The legislative branch MAKES the law, the judicial branch interprets the law and the executive branch enforces the laws. How on earth can you folks call yourselves a news organization if you can't even pass high school government?

70. The legislature is called the legislature
because legislation is its specific power. The executive branch EXECUTES the laws made by the legislative branch. It's called separation of powers, you CNN morons!!!

72. Then lets save tax money and eleminate congress...
If the President can do their job, then what do we need them for?

People seem to be reading the first part of the articles or amendments and skipping the rest. Just like the "Christians" read the bible.

Amendment 1 - (1791)
Congress shall make no law respecting an establishment of religion, ...

74. Reverting back to their CNN and PsyOps days, I see
CNN and PsyOps
www.counterpunch.org/cnnpsyops.html

along with Operation Mockingbird's illegal domestic 'catapulting the propaganda'
www.spartacus.schoolnet.co.uk/JFKmockingbird.htm (scroll down past the ads)

we find that the MSM is not telling the truth, or offering anyone in the US or outside the US a decent respect for the opinions of mankind, as Jefferson once put it. Fabrications and sleight of hand are now the order of the day, called out by the deceiver-in-chief and his false prophet (Rove).

The world already is aware of the damage the current national 'wrecking crew' is doing, not only to the economy but to the environment and now to the constitution itself. When the * supporters finally realize the true extent of what they've done (I really need to hear the spin on this upcoming SOTU address, since the media already knows the past years haven't been good for *), they will be begging for Democrats to right the sinking vessel they've left the country to deal with.

The two political parties now look like Laurel and Hardy. It is with little satisfaction that I say that "Well, Stanley, this is another fine mess you've gotten us into". Stanley = the R's.

Does Bennett have a problem with the word "legal" like George does?

please. I can't hide them because of the traffic restrictions, so post them either in "Conservatives" or "Editorials"

80. These ass-hats didn't think this during the Clinton years...
Edited on Fri Jan-27-06 03:05 PM by Az_lefty
''Stroke of a pen, law of the land, kind of cool.''
Remember when Paul Begalla said this? The wingers went nuts.

Bob Barr, as chair of the Subcommittee on Commercial and Administrative Law had this response:
"Fidelity to constitutional self-government requires adherence to the formal legislative process the framers skillfully drafted into our founding document. When Congress yields its delegated powers to the President, or fails to check executive overreach, it not only undermines its own power, but mars the constitutional fabric carefully tailored by the Founders to preserve and protect our individual liberties."

It's funny how soon these hypocrites forget.

On Edit: here's a link to the Hearing minutes from 2001.

81. Bob Barr has actually been consistent on this
I have to give him a little bit of credit. The rest of the conservatives, though, are being extremely hypocritical.

84. BWAHAHA - this from Mr "Moral Relativism"
D*mn if this doesn't invite the question of Mr Bennet would he have said the same about Clinton had the first World Trade Center been worse and required a War On Terror.... we know he would start to equivicate and give a performance of active moral relativism (which he used to use rhetorically as a pro repub anti dem phrase.)
