Bush was a DESERTER, Concrete Proof Here!!!!!
We know bush was AWOL no doubt, but was he a deserter?
Bush applied for separation and then left for Harvard Business School, before his discharge was approved, with the intent not to return. He was not present to sign his discharge papers on 1 Oct 73


Texas Military Code.:
Acts 1987, 70th Leg., ch. 147, § 1, eff. Sept. 1, 1987. § 432.130. Desertion
(a) A member of the state military forces is guilty of desertion if the member:
(b) A commissioned officer of the state military forces who, after tender of his resignation and before notice of its acceptance, quits his post or proper duties without leave and with intent to remain away permanently is guilty of desertion.


THIS IS THE CONCRETE EVIDENCE ONCE AND FOR ALL!!!!

1. Ummm...
... the date of the act is 1987. And, Bush never tendered his resignation during the time in question.

W was AWOL after guarding TX for a bit during the Vietnam War.

Isn't that enough for Clark to decimate him? Isn't that enough for veterans, when given the choice of a general or an AWOL (deserter), to just not be able to vote for W?

4. As much as I agree with you
in spirit, look at the effective date of the code. What was the wording at the time of his skipping out in '72/'73? I can't imagine that it was much different, but for the word parsing diehards, well, y'know.

5. UNIFORM CODE OF MILITARY JUSTICE
SUBCHAPTER X. PUNITIVE ARTICLES
885. ART. 85. DESERTION
(a) Any member of the armed forces who--
(1) without authority goes or remains absent from his unit, organization, or place of duty with intent to remain away therefrom permanently;
(2) quits his unit, organization, or place of duty with intent to avoid hazardous duty or to shirk important service; or
(3) without being regularly separated from one of the armed forces enlists or accepts an appointment in the same or another on of the armed forces without fully disclosing the fact that he has not been regularly separated, or enters any foreign armed service except when authorized by the United States; is guilty of desertion.
(b) Any commissioned officer of the armed forces who, after tender of his resignation and before notice of its acceptance, quits his post or proper duties without leave and with intent to remain away therefrom permanently is guilty of desertion.
(c) Any person found guilty of desertion or attempt to desert shall be punished, if the offense is committed in time of war, by death or such other punishment as a court-martial may direct, but if the desertion or attempt to desert occurs at any other time, by such punishment, other than death, as a court-martial may direct.

7. I really don't understand the quandry
of AWOL vs Deserter...

HE WASN'T THERE!!! Wes Clark's campaign with Michael Moore took the hits. Remember the press going nuts? Remember Kerry saying Clark was "over the top?"

Now everyone wants to talk about it, & Sen Kerry becomes the beneficiary?

Baloney!

9. No one wants to take the chance of being the next
to die in an airplane crash. Technically he wasn't awol because he was never charged- he was just GONE for over a year.

you do not have to be charged to be AWOL. He was AWOL and he was a DESERTER. See above. you have to be AWOL before you can be charged. Therefore the AWOL does exist with or without the charge.

Because he wasn't charged?

So. . . by that logic if I kill someone and am never charged with murder, I'm not a killer?

If I break into someones home and steal their belongings and am never charged with burglary, I'm not a thief?

Sorry, but if you are absent from your duty station without permission, that means you were AWOL. Whether charged or not, being absent without leave means you were AWOL.
