GOP tries to remove Delay lawsuit to Federal Court
The Texas Democratic Party has sued to keep Tom Delay's name on the ballot for the November mid term elections or to prevent the GOP from replacing Tom Delay on the ballot. One of the grounds used was based on the US Constitution's definition of what is required to be eligible to be a representative. The Texas Democratic Party filed the case in Travis County and have already obtained a temporary restraining order from the judge.

The GOP has responded by filing a motion to remove the case to federal court based on federal questio jurisdition.
