DeLay Dispute Moves to Higher Court

By KELLEY SHANNON

AUSTIN, Texas Jul 7, 2006 (AP)— With state election deadlines closing in, the legal fight
over whether to keep indicted former U.S. Rep. Tom DeLay on the November ballot moves
next to a higher court.

The Texas Republican Party plans to appeal federal Judge Sam Sparks' ruling Thursday that
DeLay must remain on the ballot even though he resigned from office and isn't actively
campaigning for re-election.
<snip>
The appeal will go to the 5th U.S. Circuit Court of Appeals in New Orleans, where Bopp hopes
to get a decision this month allowing the GOP to replace DeLay on the ballot.

Democrats say don't bet on it.

1. Har de har har!
Thanks for sharing, I'm loving this! Back when The Hamper won the primary I said I was glad because I wanted to see him get his ass kicked in the general. A couple of things are now obvious to Sugar Land Republicans:

He ran in the primary, planning all along to resign, so that he and his cronies could pick the Republican candidate for the general election. This was a deliberate scheme to deny Republican voters of their right to pick the Republican nominee.

Another reason he ran in the primary was so that he could keep campaign contributions and use them for his legal defense after he resigned.

In addition to all his other troubles, now he'll be on the ballot after all. Maybe one or two of those Sugar Land Republicans are just a tad annoyed at him, on account of these two bigtime slaps in their faces, ya think? I'm having a boatload of fun watching this race!

6. Nope.
If he resumes his Texas residency before election day, he can take office again. If he doesn't resume his residency, he would be ineligible for election and there would either be another election, or the 2nd-place vote-getter would be declared the winner.

3. It's funny how the Repubs are all mad at the Demos for bring suit when
Delay is the one who put them in this position in the first place. Another one who cared only about himself and screwed the party he professed to love. Just like Joe.

4. One of DeLay's staffers is black. Therefor you liberals are all racists.
Also he has some female staffers. You ever notice how these socalled "progressive" Democrats always attack Congressmen whenever they have female staffers? Pretty clearly they're women-hating racist abortionists. And soft on ozone. They love owls, but hate jobs. Why do you liberals hate jobs? Because they're American jobs? Figures.

7. They'll keep judge-shopping til they find their kind of judicial activism.
It worked for Cheney and his Energy Commission records.
