Individual can by just checking a box.

Does anyone know if this is true????

1. yes that is true.
default on AIM is to save the messages.

I doubt your ISP knows anything about them.

5. I was asking because if it was an individuals decision, does that
mean this 16 YO decided to deliberately keep this stuff? If save is the default, then the answer is no.

all IM programs have an option to save the conversation locally to a text or html file.

4. Yes and no...
...YES, any individual CAN save their IM history. It's usually a series of settings in the option/preferences dialogue.

and NO, they are incorrect about the ISP, and indeed, any intermediary agencies or entities. IM communication is pretty insecure, and anyone positioned anywhere along the "series of tubes" between yourself and the person you are communicating with can capture and buffer your interaction.

6. Jeebus...
With AIM, it saves everything you do in .tmp files, so even if the archiving is turned off, it's all still there on the HDD.

I have seen a number of HDDs that have been filled up with these .tmp files.

7. Heck yeah. You can save them forever. Right there on your computer.
If the pages saved them, one can only imagine that Foley saved them as well.
You know, for those lonely nights when he couldn't find a page to turn. ;)

(His computer/s should be in police custody. Last I read, Foley still has them.)
