Would Roberts and Alito have been confirmed if they would have .....
faced the current Senate.

I would hope not but I really don't know.

What does everyone else think?

8. Yes there are - you only need 41 to filibuster a nomination
Also, it is likely that Alito might not have been voted out of the Judiciary committee.

Just as there aren't enough WILLING to start impeachment. What it would take to get these lumps up to do their Constitutional duty, I don't know.

Now that we have the majority, only one person is needed - Chairman of the Judiciary Committee, Senator Leahy of Vermont.

4. Roberts, yes: The Democrats were split evenly, but the Republicans all voted for him.
Same thing would have happened in this Congress, so the vote would have been tighter but still decisive enough.

Alito, maybe not. The committee vote was straight party line -- then, however, Republicans controlled. Now that Democrats control, the nomination may never have even gotten out of committee.

5. Yes. Some surprising Dems voted for Roberts
Including one of my favorite Senators, Russ Feingold.
I was disappointed, but one bad vote is not enough to make me abandon him.

At least not if someone rational ran the White House (which is clearly not the case.) No, they'd not be confirmed. Their nominations would not even make it to a vote.
