When asked about the type of Justices he wants:
1. 95% of the time the law is so clear, its just a matter of applying the law.
2. In those 5% where it isn't clear, the judge then has to bring in his or her own perspectives... in those circumstances, what I do want it a judge who is sympathetic enough to those who are on the outside, those who are vulnerable, those who are powerless, those who can't have access to politician power and as a consequence, can't protect themselves from being dealt with, sometimes unfairly. That the courts become a refuge for justice.
3. We've got to make sure that civil rights are protected, we've got to make sure that civil liberties are protected, because sometimes there are pressures that are placed on politicians to want to set civil liberties aside.
Those are all criteria by which I will judge an appointee.
After hearing that it just struck me, when Obama takes office - we will have amazing justices placed on SCOTUS that will protect my children's rights for decades to come. Scalia and Roberts will just issue the dissenting opinion instead of pissing me off and worrying me.
