Why should Democratic "pragmatism" be defined in terms of caving to fascism?
Why should "swing voters" be defined in terms of the worst and lowest moral/intellectual benchmarks, as being governed by fear rather than hope? Those aren't "swing voter" benchmarks, those are benchmarks of the Bush/Republican BASE. Those benchmarks are nothing else than requirements for getting away with systematic lying, systematic destruction of the rule of law - as this can happen only under cover of a cloud of fear and hatred, distrust and division. Those are the benchmarks of an extremely unpopular administration, whose policies CAN NOT BE and ARE NOT definitive of the political sense of "swing voters".

Arguments in favor of a so-called "pragmatism" which is indistinguishable from assenting to the Bush/Republican agenda bespeak a moral/intellectual bankruptcy, a lack of substance, and a political cowardice that de facto DENIES any real opposition.

2. If I knew the answer to these questions
I wouldn't be doing what I do for a living. Any answer I could give would be anecdotal or snarky and would not necessarily answer any questions.

4. My understanding is the new FISA law still allows for civil suites for actions BEFORE 911 & criminal
...prosecution.

I don't like the term "exigent" though, it gives the president too much power.
