"The Democratic Party, and Mr. Obama and the Republican Party and Mr. McCain blatantly ignored the Texas statutory deadline.

Therefore, the Libertarian candidate for president, Bob Barr, as represented by his principal campaign committee, Bob Barr 2008, demands that your office keep the names of Barack Obama, Joe Biden, John McCain and Sarah Palin off the Texas general election ballot.

Failure of the Secretary of State to comply with Texas law will result in serious legal consequences."

Does he have a leg to stand on? I looked over the documents, and it seems as though he does.


It's good because McCain was counting on TX- Bad because it's going to willfully disenfranchise all those voters.

7. They won't be disenfranchised. They can still write-in their candidate.
And since Republicans can't spell, I predict Texas will go to "Jon Makan"

13. I'm not sure.
If I want to take the most restrictive reading that I can get (from Texas Elections Code 172.002, 192.031, and maybe 182, I get McCain's name as having been certified--possibly improperly--but at least certified. Obama/Biden aren't mentioned, neither is Palin. I'm not sure of the limitations of section 172; for all I know it's impossible to apply it in this context. It's the only thing putting McCain's name in play before the deadline.

Slates of electors are properly submitted, whether or not the list was revised is immaterial.

Don't know about amending things. You can do some stuff after the deadline, if I read it correctly.

Gotta love disenfranchisement and heroic and principled attempts at it.

actually think this will keep Obama/Biden and McCain/Palin off the ballot? The Texas legislature can easily pass a new law changing the deadline, or perhaps the Governor can simply issue some sort of directive.

And of course, in reality it's the slate of electors that's being voted for, not directly for the president and vice president. And in fact, in looks as if both political parties have supplied those to the proper authorities.

This is a lot like the assertion that McCain isn't really eligible to be President because he was born in the Canal Zone. Doesn't fly.

14. Think of it this way
If TX was going to go to the Repugs it won't if things don't change.

I believe that this gaff was intended to trip up the Dems, remember the Repugs changed a lot of rules to benefit themselves and now they are getting burned by the same rules.

15. I would seriously cry.
I've been looking forward to voting for Obama for more than a year. It's a historic vote. I was an Obama delegate.

If I didn't get to vote for him in the general, I'd be so cheesed off. My 14 year old daughter wanted to go with me just so she could say she was there.

But if this would help Obama, then I'd have to be happy about it. If it would hurt him, I'd be doubly upset.

WTF? I guess I need to be following this, but I can't imagine that they'd actually leave everyone off the ballot except Barr.
