Libertarian candidate: McCain, Obama should not appear on ballot
Presidential candidates John McCain and Barack Obama should not be allowed to compete in the November election in Texas.

At least, not according to Libertarian presidential candidate Bob Barr.

Both candidates knowingly missed the Texas deadline to file for a place on the Texas general election ballot, said Russell Verney, Barr’s campaign manager.

For a political party to have the names of their nominees for president and vice president of the United States on the state ballot, they must submit the names of both candidates before 5 p.m. on the 70th day before the presidential election, according to the Texas Election Code.

That deadline, 5 p.m. Aug. 26, passed before Obama was nominated and before McCain chose a running mate, Verney said.

“The Election Code of the state of Texas imposes requirements on a political party, which must be met if its candidates for president and vice presidents are to appear on the general-election ballot,” Verney said in a letter to the Texas Secretary of State’s office. “The Democratic party and Mr. Obama, and the Republican party and Mr. McCain, blatantly ignored the Texas statutory deadline.”

Exceptions should not be made for major-party candidates, Verney said.

1. I don't know how many times this has been debunked.
They're both going to appear, and McCain will win it.

Takes those EV votes off the table completely.

5. Mccain may not win Texas.
The Democratic turnout for the primary was huge. Early voting makes polling very difficult. This is a place that Hillary should campaign intensively with Barack.

7. I'm sure Texans of both parties will take that as politely as they are able.
I suggest the meek stay out of the path of the Texas Secretary of State's office if Barr succeeds.

9. Barr is an idiot.
Taking advantage of a silly technicality is the one way he might have a chance in hell of winning. I'm not in favor of voter disenfranchisement, regardless of who benefits from it.

16. is it a state law, or a 'silly technicality'?
did you support the Supreme Court when they ended the 'silly technicality' of the Florida recount in 2000?

17. Seriously?
Are you honestly placing the 2000 Florida recount at the same level as not getting a ballot application turned in on time because the candidates hadn't been officially nominated yet?

Seriously?

wow.

10. I agree with Barr
Barr can get the electoral votes in Texas and hurt McCain who is set to win Texas. That would be great for Obama!
