Denver 5th Grader Suspended For This T-Shirt: "Obama A Terrorist's Best Friend"
Student says he was suspended for anti-Obama shirt

Associated Press - September 23, 2008 3:03 AM ET

AURORA, Colo. (AP) - A Colorado fifth-grader says he's been suspended from school for wearing a homemade T-shirt that said "Obama is a terrorist's best friend."

Daxx Dalton and his father, Dann Dalton, say his First Amendment rights were violated.

School officials in Aurora -- a Denver suburb -- say they respect students' free speech rights but also watch for things that might interrupt the learning environment. They say they can't discuss the specifics of the case.

The boy says he was given a choice of changing his shirt, turning it inside-out or being suspended, and he chose suspension.

His father tells a Denver television station he's considering a lawsuit.

Dax is a fictional entity on the television show Star Trek: Deep Space Nine.
In Star Trek Deep Space Nine Dax is a Trill symbiont, a very long-lived slug-shaped entity that is hosted by a succession of humanoid Trills, a process called "joining". ...the kid can wear it.

"Disruptive" clothing would include gang stuff, etc.

But the "political t-shirt in schools" thing has been beat to death.

please in a school setting? What nonsense. Should they be able to peacably assemble anytime they wish is school? Should they be free to wear shirts proclaiming that their teacher is a fascist? Hey, those are first amendment rights too.

32. A political statement is not "whatever they please"

Words on a shirt, if they aren't vulgar, should NEVER result in a suspension.


Asking him to change his clothes or turn the shirt inside out should be enough.

The Supreme Court had a split decision in that case, but generally ruled in favor of the school's discipline. And if this nutjob tries it, he might run into the same type of ruling - say like 5 - 7 years from now if they don't dismiss it out of hand?

The irony of the "Bong Hits 4 Jesus" case was that the incident occured in Alaska (in 2002) and when the ruling was handed down in 2007, Palin was governor! :rofl:

21. I fully support the kid on this one.
Two things:

Moronic sentiment or not. there are free speech arguments that heavily favor the right to express oneself.


Second, rather than being necessarily disruptive it can be a great object lesson on the presidential race and free speech issue and the responsibilities in a civil society,

HIs fifth grade class ought to engaged in several days of discussions about rights and resposnisibilities and about this election.

To suspend the kid for being publically engaged in this years election is a wast of everyone's time and ihas a chilling effect on impressionable minds.,

school children aren't covered by first amendment rights in school. They are not free to speak when they wish or say what they wish. they aren't free to assemble where and when they wish. It's absurd to suggest that they are. And as someone in another thread put it, what if the kid had worn a shirt proclaiming that his principal is a terrorist's best friend? There are limits to speech in the school house.
