5. 95% - the supreme court justice one got me as I took it as who 'approves'
so I don't feel so bad because I knew the president actually chooses but doesn't have final say.

If the President's nomination is dependent on Senate confirmation, the Senate is the deciding body.

There was one question which to this day I can't answer, but neither could the examiner.

It was in December of 94 when I went for my test. The very first questions were on presidential succession. He asked who the president was and I said "Bill Clinton" (those were the days.....). He asked who would become president if Bill Clinton died and I replied "Al Gore". He then asked who would become president if both died at the same time and I responded.....

"I don't know".

He looked a bit surprised, but luckily I recovered quickly enough to explain I meant that I knew it would be the Speaker of the House but that Foley had not only lost his majority but his actual seat too and that since Congress was not in session the Republicans had not yet elected the next Speaker who would probably (and did) end up being Gingrich, but that I had no idea if that would be official should a presidential succession be necessary.

I still don't know (my guess is that the House would be called into emergency session to elect a Speaker/president but buggered if I can find any cite for that thenm or now).

Turns out he was happy with "Speaker of the House", said he didn't know either and we went on from there.


EDIT - just to make sure the intervening years and beers had not made me less worthy, I ran through this check and got them all. 19 is a bit unfair to those who have not gone through the process and a careful reading is needed for the 13 states, but the rest should be doable for most DUers I would hope.

Don't know if it's right or not, but never thought of it. However would there have been a president pro tem in a year in which the Senate changed hands and Congress was not in session any more than there was a Speaker?

That the Presidential Succession Act on 1947 is unconstitutional because the language of the Constitution says that "No Senator or Representative shall, during the Time for which he was elected, be appointed to any civil Office under the Authority of the United States."

In your scenario, I imagine Congress would have to have an emergency session to nominate a speaker of the House, and then the offices of the President and Vice President being vacant would allow the new speaker to assume the office of the President and to nominate his or her VP by approval of the Senate.

However, if it were to come before the Court in Original Jurisdiction it may be deemed a political questions and as such it would be outside of the purview of the Court to review.

49. Strangely enough, I think that Foley would have still been next in line
I'm only guessing here, but I believe that Foley would have still technically been Speaker of the House until the next Congress was sworn in. Even though he was a lame-duck Speaker, he was still Speaker, so he was next in line. Presumably, if a Speaker had to fill in as President, then they would need to resign their seat anyway, so the fact that they lost their seat should not be a factor.

That doesn't mean that they agreed with religious freedom for others, and the answer to the question doesn't say so. They came for their own religious freedom.

English America was first a stock company just like any other, with sold shares authorized by Elizabeth I (so was Bermuda btw). Jamestown VA predates Massachusetts by 15 years, and Roanoke VA had settlers in 1585 under Sir Walter Raleigh.

There were some questions I had to make educated guesses on and double check to make sure I didn't trip myself up logically.

Surprised because I thought the questions would be easier as I had helped my mom pass her naturalization test a few years earlier but then again, the test might have been raised in difficulty since then.

I became a US citizen three years ago. And yes, the exam was oral, and no choices were given. But ... none of these questions were asked! The actual questions were really easy - like, how many senators does each state have? Who are your senators? Who is your representative? At what age can you vote? The 'quiz' lasted for only about ten minutes or so.

I argue that #14 is a poorly worded question. Both the President and the Senate select SC judges.

#17 is wrong as well.

The Pilgrims were a mix of puritans who "fled religious persecution," as well as other regular colonists- assorted scoundrels and adventurers.

Gave me pause, but the more I thought about it, I became pretty sure none of the 10 in the Bill of Rights addressed voting, so picking the 7th was the logical choice.

I missed 19 like a lot of folks, but I was thrilled with 95 percent. Yay me!

I heard they changed it somewhat now. They removed some of the redundant questions about the flag and emphasize more on getting some thought out answers by rewriting some of the questions, from "What is the Constitution?" (Answer: "the supreme law of the Land") to "What does the Constitution do?" (Answer: well... go for it).

So yes I passed it and got my voter registration. It says "Party: DEM".
