Distributor of phony election flier in Virginia found: No charges will be filed.
This is a flier that told Republicans to vote today (Election Day) and Democrats to vote tomorrow. No charges will be filed because, you know, it was just a joke. Ha ha!

State Board of Elections Secretary Nancy Rodrigues said Monday the flier bearing the Virginia seal and the elections board logo was a joke that got out of control. The flier was distributed early last week across Hampton Roads. State police confirmed it also was distributed by e-mail.

2. Wow...what a defense
"Yes, your honor, I shot and killed the man in cold blood with malice aforethought, but it was just a joke."

4. I Don't Normally Favor Vigilantism
But I might in cases such as these. I'm strongly in favor of dung-heaps who want to pull this kind of crap seeing plenty of evidence that they may face some very, very ugly consequences.

8. I never favor vigilantism.
But these cases need to be prosecuted.

11. 'Never' Is a Big Word
If we woke up tomorrow morning to President-elect John McCain coupled with a Bush declaration of some form or gradation of martial law, would you favor vigilantism then?

I'm not saying I would -- but I might.

6. Yes. And even if it was a joke, it doesn't effing matter.
I'll try that next time I get pulled over for speeding. "60 in a school zone? O' come on, it was just a joke!"

5. Amazing
If you made it a crime on the level of stealing mail, it would end. THIS is why it goes on.

7. Try joking about a terrorist attack. Why is "joke" suddenly a defense?

9. How could this not be the most illegal thing ever?
A joke? WTF?

If McCain wins can we have a redo and declare it all just "a joke"?

10. "kidding on the square" as Franken would say
it's when people do something intentional and when they get caught they say they were "just joking".

When you're going to go to the lengths of using the official seal and elections board logo it goes well beyond "just a joke"
If you wave a weapon around and it goes off and kills someone and you say you were "just joking around" it's still manslaughter (unless you're Cheney and you shoot someone in the face they we don't even investigate until we know every thing's been clean and sobered up)
If you yell "hi Jack" to a friend in the airport, you're still going to get you ass handed to you
