Delaware wins ruling against New Jersey in LNG case

Delaware has the right to block a massive liquefied natural gas delivery pier proposed by energy giant BP for the New Jersey shore of the Delaware River, a U.S. Supreme Court special master has ruled.

In a ruling made public today, Special Master Ralph I. Lancaster concluded that Delaware, “as the sovereign owner of the land,” can regulate and police developments extending from New Jersey’s shoreline into the waterway.

The decision – still subject to Supreme Court review – amounts to a victory for Delaware officials who ruled BP’s proposal a violation of the state’s ban on new heavy industries and bulk unloading piers in the protected Coastal Zone

Lancaster’s decision potentially jeopardizes a multi-billion dollar LNG import venture that BP proposed for land in Logan Township, N.J., opposite Claymont. Although gas storage and pipeline equipment would stand inside New Jersey, a more-than 2,000-foot off-loading pier would extend across the state line and into Delaware.

Most observers saw a U.S. Supreme Court fact finder's ruling on jurisdiction over the Delaware River as a clear win for Delaware.

Not BP.

For good reason. Demand for clean-burning natural gas is on the rise around the globe, and BP is falling behind in a national race to build terminals to meet the country's hunger for the fuel.

Of the more than 40 terminals proposed for the United States -- including BP's terminal proposed for the New Jersey side of the Delaware River directly opposite Claymont -- only 12 will be built, the Federal Energy Regulatory Commission estimates. And if any of the four other LNG projects proposed for the Northeast -- from Maine to the Chesapeake Bay -- are built, the market for a BP terminal in New Jersey would be diminished
