January 9, 2008The DuPage County Election Commission has asserted for years that it has the right to destroy election records, most just a few months after Election Day. But a state agency says the county is wrong in trashing files without first getting permission from the Illinois secretary of state's office.
Election Commission members met in closed session Tuesday to discuss a recent official opinion by the Illinois attorney general that says the commission is subject to the requirements of the state Local Records Act, which requires that local governments get permission from the Local Records Commission before destroying official documents.
Unauthorized destruction of government records can be a felony, but DuPage State's Atty. Joseph Birkett said Monday that he does not contemplate any enforcement of the law in this case."The Election Commission was acting in good faith on the advice of counsel on a matter in which there was a legitimate difference of opinion," Birkett said, adding: "I think everyone will accept the attorney general's opinion and just move on."
