Questions about provisional ballots in Ohio
Regarding the article below by Bob Fitrakis, I have three questions.

If you can only answer one question, that is fine.

Thanks in advance.

1. Were people asked for their birthdates when they cast provisional ballots?

2. Are the ballots being thrown out when they don't have a birthdate, or just set aside?

3. Are some provisional ballots in "yellow packets" and not others?

And so the sorting and discarding of Kerry votes begins

November 10, 2004

Are the provisional ballots in Ohio being thrown out? A new rule for counting provisional ballots in Cuyahoga County, Ohio was implemented on Tuesday, November 9 at approximately 2:30 in the afternoon, according to election observer Victoria Lovegren.

The new ruling in Cuyahoga County mandates that provisional ballots in yellow packets must be “Rejected” if there is no “date of birth” on the packet. The Free Press obtained copies of the original “Provisional Verification Procedure” from Cuyahoga County which stated “Date of birth is not mandatory and should not reject a provisional ballot.” The original procedure required the voter’s name, address and a signature that matched the signature in the county’s database.

1. Okay We need to see a Lawyer
UHH this would violate every single rule for fair elections, when people are expected to follow the rules, and do then someone changes the rules so they do not count there is a huge problem in this country. If I tell my kids not to drive after Dark and then suddenly change the rule to Dusk without telling them and punish them for violating I am wronging them, Blackwell is wronging the voters in Ohio Period no middle ground here Wrong is Wrong!

2. Perhaps trying to run out the clock

Changing the rules so that even if they are reversed and have to go back and do the right thing under court order, there is no time left to do it within the federal time constraints.

3. I worked a polling place 11/2
Each provisional ballot must be in its yellow envelope or it doesn't count.

There is a sticker that attaches to the yellow envelope where the voter fills in personal info (including birthdate) and signs a statement that they are telling the truth about who they are, etc. If that sticker isn't filled out, their vote doesn't count.

Every provisional voter was to be told that there was a possiblity that their vote would not be counted.

4. OK, thanks
I still think they should contact a voter who left out information, instead of just tossing his or her ballot.

5. This is exactly why Ohio needs a recount
I worked at a polling place on 11/2 also but those whose information is in order shouldn't be denied their vote arbitrarily. It's that simple

7. Exactly!
We had people who were told they weren't on the list because the poll worker didn't know the alphabet!

If they were given a provisional ballot when they were on the books, I don't care if they forgot to put something on the jacket of the provisional ballot...the provisional ballot they shouldn't have had in the first place...in some cases.
