Hill’s bill said ((sic)) the department is prohibited from requesting the serial number, model number, manufacturer or make, type, caliber or whether the applicant owns the handgun used for the safety course. The only information an applicant would be required to furnish the department or department-approved safety course is the application information currently required by law.
At least one local gun dealer said he doesn’t understand why gun owners have a problem with such legislation because guns purchased legally are documented by state and federal law enforcement.
“The FBI and the TBI requires the serial number of any gun legally sold, and if it’s a handgun it has to be sold to a state resident. That’s why you pay that $10 background check fee to TBI when you buy a gun,” said Steve Birchfield at Crowder Vac and Gun Shop, 3744 W. Market St., Johnson City.
He said such a law is to the benefit of guns sold illegally at flea markets and at gun shows.
“You go to one of those shows, and you’ll see more guns sold off the tailgate than inside. There should be stricter laws against the criminals,” Birchfield said.
Rep. Hill's HB0045 phallus legislation demonstrates that the Jonesborough legislator seems to be terribly confused and apparently still learning on the job...in absence of or prohibitd by existing state law, state agenices can implement rules and regulations with the effect of law.
It seems to me that a more rational approach to firearms sales in Tennessee would involve titling each individual firearm that is legally sold in Tennessee (just as motor vehicles are titled) as another tool for law enforcement officers to protect the citizens of the Volunteer State.
