John Cornyn caught lying about legal support for his filibuster argument
Looks like blogger KargoX has caught Sen. John Cornyn deliberately misrepresenting a source in an effort to prop-up the GOP's argument against the filibuster. Basically, he purposely distorted what a professor said in order to twist her words to fit his argument that the filibuster is unconstitutinonal. KargoX reports that he contacted the professor in question, who reportedly said she is aware Cornyn is doing this, and has asked Cornyn to stop, but to no avail. He keeps on doing this.

It's all covered here by DailyKos:

http://www.dailykos.com/storyonly/2005/4/4/22362/70789

I have already sent this as a news tip to the San Antonio Express News, Dallas Morning News and Austin-American Statesman.

You can help by contacting your local media and asking them to cover this aspect of the Cornyn story.

Sen. Cornyn is, of course, a laywer and is bound by the Texas Rules of Ethics for lawyers, which prohibit a lawyer from engaging in "fraud" or "deceit." Perhaps you should also contact the Texas State Bar to see if they would interpret this deliberately flawed legal analysis as a violation.

I'm wondering if there isn't an Al-Qaeda cell in Congress?

2. PLEASE - send it to Keith Olbermann of MSNBC too
It's exactly the kind of thing he might pick up and put on the air. He knows these neocon wackos are trying to destroy the constitution and wants the truth out there.

In his blog,
http://msnbc.msn.com/id/6210240
Keith asks for comments and tips and says he is very glad to get them, if they have documentation, which you have. His email is
KOlbermann@msnbc.com

It would be wonderful if he interviewed the professor on her show!

There are lots of other blogs to send it to also.

This is IMPORTANT!!! Recommended!

I will forever be grateful when the pendulum swings the . . . other way across America, politically. To rid America of these lying s.o.b.'s who pander their illogical and deceitful rantings to the unknowing, uneducated, and unsophisticated . . . like sleazy snake oil salesmen.

Unfortunately, these s.o.b.'s are robbing America of far more than mere dignity and honor. They are fleecing America, robbing us of a future as they attempt to, and are, turning the legal clock back to the 1890s and afore when unfettered corporations ran riot over the general public, and individual rights didn't exist according to the U.S. Supreme Court.

4. KICK!!! This is EXTREMELY IMPORTANT!!!
I have sent word of this thread and the story it breaks to several people, including LaLa_RawRaw of Raw Story, who says she sent it to the editor. I have not yet sent it to Keith Olbermann, and I hope that you will do so.

I also hope this story gets voted onto the Greatest page. All three legal experts Cornyn cites as supporting his contention that filibustering is illegal say he is misrepresenting their positions!! And even when they ask him to stop, he keeps lying!!! This has GOT to get out!

5. Cornyn is good at ignoring people.
He has never deigned to acknowledge countless letters, not one single response! Which, I suppose, is a response in itself...

8. Lies and Liars
This problem is so systematic on the repuke side. They take and distort someone's words to fit their view of reality. And in some cases they outright plagiarize entire pieces of writing and claim them as their own. Cornyn obviously doesn't know the meaning of ethics for lawyers.

Glad to see that the well-known legal scholars are fighting back, but of course it's the media that fails us. They're become so bottom line oriented that they lazily take these rantings by C. Boyden Gray and pass them off as facts. No fact checking whatsoever.

This is the link on Daily Kos that goes to the matter of the distortion. It's a must read

http://thenexthurrah.typepad.com/the_next_hurrah/2005/04/notes_on_the_nu_1.html
Now, to top it all off, not only are they throwing out the rules and abandoning the constitutional underpinnings of their arguments, but they're using once-respected names in the political and legal community to mislead the press and the public into believing that even "liberal" law professors agree with them.

10. Excerpt from Professor Bloch's March 14 memo to Cornyn:
Edited on Tue Apr-05-05 01:43 PM by Nothing Without Hope
The full text of her memo to Cornyn complaining about his misrepresentation is on this page (scroll down)
http://thenexthurrah.typepad.com/the_next_hurrah/2005/04/notes_on_the_nu_1.html

Excerpt:

To: Senator John Cornyn
From: Susan Low Bloch
Date: March 14, 2005
Re: Misrepresentation in your "Talking Points" on the Filibuster

Senator John Cornyn and C. Boyden Gray have seriously misrepresented my views. In a February 28, 2005 memo to journalists on behalf of the Committee for Justice, Mr. Gray suggests that I said the Senate's use of the filibuster against judicial nominations is unconstitutional. In Senator Cornyn's "Talking Points" on the Senate Process of Confirming Judges, referred to on Mr. Gray's website, Senator Cornyn makes the same misrepresentation of my views. In fact, I have never said such a thing. On the contrary, in the article they quote (but never cite), I said precisely the opposite, explicitly distinguishing the Senate filibuster from the House Rule that I was criticizing.

(snip - more at link)

I do wonder if Cornyn can be prosecuted for willfulling misrepresenting a professional scholar's statements on the Senate floor to push his agenda?

12. I would think that they can sue for slander.
But I'm not a lawyer so I can't say for sure. It might be that Senators are immune from such things.

14. Kick! Needs to be seen! And the professors need to be interviewed.
Those memos and other documents that the blogger has indicating Cornyn willfully lied about their stated positions need to be confirmed by speaking to the professors directly - and then this needs to be pushed hard. Great ammunition for the Senate debate on the constitutiionality of the filibuster. Cornyn is lying and he MUST be called on it!!! His own three legall experts believe the opposite of what he claims!

16. If I were a journalist, I think I'd try to talk to the professors first to
be sure I had the facts all straight. Then I'd select a few pointed quotes like the ones in the memo excerpted above, interspersed with other questions - and see about getting a response from him.

No, I haven't tried to call his office. I have sent this story around to a lot of people, but so far the media hasn't picked it up.
