It's crunch time - let's start writing party resolutions!
I'll even suggest the first resolution to write up. How about a resolution that would outlaw forcing all potential homeowners in Texas to submit to mandatory arbitration instead of lawsuits if something goes wrong with their homes?

1. Here's one on clean elections for Texas

A Texas Public Campaign Financing Resolution


WHEREAS, campaign funding at all levels of government has soared in recent decades; and

WHEREAS, potential candidates are usually not considered viable without wealthy and economically powerful supporters; and

WHEREAS, under the current system of campaign financing, the average citizen cannot match the political influence of the economically powerful; and

WHEREAS, candidates and elected officials are required to spend a huge proportion of their time, energy, and staff raising funds rather than meeting with constituents; and

WHEREAS, the public interest has taken a back seat to the private and special interests which are influencing decisions made by our elected representatives; and

WHEREAS, public financing of campaigns has been successfully implemented in seven states and two cities;

NOW THEREFORE BE IT RESOLVED, that the Texas Democratic Party finds and declares that the unique factual circumstances in the State of Texas require that provisions for publicly financed elections be enacted to promote the compelling interests of democracy in Texas;

AND BE IT FURTHER RESOLVED, that to this end the Texas State Democratic Party meeting in convention insists that the Texas legislature during its next session commencing in January 2009, enact a law and/or pass legislation providing for such a constitutional amendment election necessary for the establishment of a publicly financed elections system in Texas. Such system would provide public financing for all state legislative and statewide elective office candidates who refuse to take any private interest or special interest campaign contributions and agree to certain spending limits. This public financing would be used by candidates to campaign for elective office adhering to all election and campaign reporting laws.

2. Here's the homeowners' arbitration resolution

WHEREAS, it is a common practice for homebuilders in the State of Texas to include mandatory arbitration clauses in contracts to purchase new homes, and

WHEREAS, such mandatory arbitration clauses prevent homeowners from taking builders to court in order to settle disputes, and

WHEREAS, arbitrators that are appointed to settle disputes between homeowners and builders are not required to adhere to Texas state law when formulating and issuing their rulings, and

WHEREAS, arbitrators in homeowners’ disputes can issue rulings that a public court of law may find poorly reasoned, and

WHEREAS, arbitrators are not required by Texas state law to provide reasons or justification for their rulings, and

WHEREAS, arbitrators in homeowners’ disputes have a vested interest in siding with the builders that render their services mandatory through the use of binding arbitration clauses, thus putting homeowners at a legal and ethical disadvantage when trying to argue disputes with builders,

NOW, BE IT RESOLVED by the Democratic Delegates of ________ County Precinct ____ that the Texas Democratic Party shall make all diligent efforts to eliminate the signing of any mandatory arbitration clauses that bypass state and federal courts as a prerequisite to purchasing a home in the State of Texas.

including mandatory arbitration proceedings;

11. Good catch - and it's a good start
I might want to see stronger language in the 2008 TDP platform against mandatory arbitration clauses, but this is very encouraging, indeed.

3. Grits for Breakfast has a GREAT one on the judicial system.

RESOLUTON CALLING FOR PRISON AND JAIL DIVERSION

WHEREAS Texas prison and jails are full everywhere in the state, costing taxpayers' billions of dollars;

WHEREAS Texas cannot hire enough guards to staff current prisons, even when money is budgeted;

WHEREAS the majority of people in county jails have not been convicted and are only in jail because they cannot afford bond, and the majority of people in prison are non-violent offenders;

WHEREAS 30% of Texas prison inmates are prior clients of the state's indigent mental health system;

WHEREAS 70,000 offenders leave Texas prisons and re-enter our communities every year;

WHEREAS the state of Texas incarcerates a higher percentage of our citizens than any totalitarian dictatorship on the planet; and

WHEREAS 90% of Texas' corrections budget is spent on operating prisons holding 155,000 inmates, while just 10% is spent on less expensive community corrections departments, which supervise more than 500,000 people combined on probation and parole;

BE IT THEREFORE RESOLVED that the Texas Democratic Party encourages the Texas Legislature to stop building expensive new prisons and instead expand funding for community corrections, including drug and alcohol treatment, drug courts and mental health services;

BE IT RESOLVED that the Texas Democratic Party encourages the Legislature to support shorter, stronger probation that gives offenders a real chance to earn their way off of supervision early through good behavior and completion of required programming;

BE IT RESOLVED that the Texas Democratic Party encourages the Legislature to fund all programming it requires of offenders so they don't take up prison space while on a waiting list, particularly for mandatory drug and alcohol treatment in adult prisons;

BE IT RESOLVED that Texas must fund mental health assessment for the mentally ill in county jails, competency restoration for the mentally ill who have committed serious offenses, and alternatives to incarceration for people whose mental illness is their primary reason for landing in jail, wherever practical;

BE IT FURTHER RESOLVED that the Texas Democratic Party urges county governments to reduce pretrial detention for those who cannot afford bond, and adequately fund legal representation for indigent defendants.

13. Oh, I am SO introducing this at the precinct convention
"Equal justice for all," indeed. Allowing the mentally ill to languish in prison without even receiving assessment, let alone treatment, is not what I would consider justice - merely neglect.

Section 1. Equality of rights under the law shall not be denied or abridged by the United States or by any state on account of sex (or sexual orientation).
bullet Section 2. The Congress shall have the power to enforce, by appropriate legislation, the provisions of this article.
bullet Section 3. This amendment shall take effect two years after the date of ratification.

6. That might be a little redundant
ERA advocates rights regardless of your gender or physiology. Assuming that someone had no sexual orientation or attractions whatsoever, that person would still be due full equality of rights under the law.

Just a thought...

Also, require the county to buy your property at their appraised value at the option of the homeowner; or,
Proposition 13 type real estate taxes.
Stop the TTC. No private ownership of highways.

I think it's a great idea, but it didn't make it through the precinct convention last time around. Maybe I can try again this year, but I don't want to waste everyone's time unless I know there's someone who will at least move and second it. We're gonna have a bunch of resolutions to consider as it is - I can feel it in my bones.

If anyone wants to draft a resolution, it has to have a bunch of "whereas" stuff in it.

The format is:
"Whereas...(statement)

"Whereas...(statement--and so forth, until you have a good list of "whereas-es")

"Be it resolved..." (add statement about what you want to come from all the "whereas-es")

Anyone want to try one on eminent domain?

The Gilbert Highland High community (From Arizona - d) is outraged that a diorama they helped build has been destroyed after Texas museum officials said it was historically inaccurate.

The 10- by 5-foot diorama of the Battle at Palmetto Ranch, the last land battle of the Civil War, was shipped in August to the Texas Military Forces Museum at Camp Mabry in Austin to be on display along with four other dioramas built by Gilbert students...

The museum, which belongs to the Texas National Guard, had a change of leadership, and the new director, Jeff Hunt, told Frakes in November that the diorama was historically inaccurate and that he had dismantled it.

Hunt wrote his master's thesis on the Palmetto Ranch battle and also wrote the book The Last Battle of the Civil War: Palmetto Ranch, which Frakes said he and his students used as a guide while constructing the diorama.

OPPOSING PARDON FOR PRESIDENT GEORGE W. BUSH AND SEVERAL MEMBERS OF HIS ADMINISTRATION

in the conduct of the office of President of the United States, George Walker Bush, in violation of his constitutional oath to faithfully execute the office of President of the United States and, to the best of his ability, preserve, protect, and defend the Constitution of the United States, and in violation of his constitutional duty to take care that the laws be faithfully executed, has planned, prepared, and conspired to commit crimes against the peace by leading the United States into an undeclared and aggressive war against Iraq in violation of Article 2(4) of the United Nations Charter, the Nuremberg Charter, Judgment, and Principles, the Kellogg-Brand Pact, U.S. Army Field Manual 27-10 (1956), numerous other international treaties and agreements, and the Constitution of the United States, and

29. I added four energy/environment ones to the BOR list
The Burnt Orange Report thread has a bunch of the ones from this thread plus others. It's easy to find as it's also linked to the top right hand corner of BOR, all the way through the election.

Make sure you download these 4 new resolutions if you can. Each of them can be downloaded from the Texas Campaign for the Environment website here.

Let's get it done!

Resolutions for Texas PCT conventions

They also have a very handy write up - what to do with your resolutions at your convention
Resolutions for your Precinct Convention
You can bring copies of as many resolutions as you wish to your precinct convention. To save time and avoid the potential problem of attendees voting to adjourn before all the resolutions are voted on, be sure to bring extra copies and hand them out to people as they arrive for the convention, right after the polls close at 7 PM next Tuesday, and ask them to read them before things get started. If everyone has had a chance to read them before they come up for a vote at the end of the convention, then it won't take too much time and you'll have a better chance of passing all of them. If some of the attendees get tired of discussing resolutions and want to go home to eat dinner or watch their favorite TV show, point out that they can leave at any time after the SD/County convention delegates have been selected. It's better to encourage them to go home if they aren't interested rather than voting to adjourn and prevent you from presenting all your resolutions.
