My next door neighbor was involved in a scam last year. The scammers took her for a total of 80K, she did not tell me about this or I would have told her it was a scam and to notify the authorities. She also took out a reverse mortgage on her house.
Because of this the DADS got involved and took her away this past February to a horrid nursing home, where she was confined. The State appointed her an attorney who wasn't really interested in justice for her sake. Then this summer she got her day in court. I went hoping to be called as a witness and the attorney had told me previously he would allow me to testify, however, he didn't call anyone to testify on her behalf. The first caseworker who took the stand mentioned how she went to the nearby neighbors asking them to make sure my friend was eating and taking her meds. She lied on the witness stand. No one asked me and I decided to investigate. I went around to my neighbors and asked them if indeed they had been requested to assist my friend. Everyone I spoke to verified they were not contacted by this caseworker.
The court decided that they would become the guardians of my friend and her estate, until my friend receives medicaid, then her niece will provide care for her, she has a retirement home she will keep her aunt in. I did try and use a legal service that WolverineDG helped me with some contact info, only problem was the victim has to contact them. Might give it another try.
So, now my friend has lost everything. The 80K is gone from assholes who feed off the elderly and now the State of Texas is punishing her as well by stealing the rest of her belongings. At least she qualified for medicaid before Perry opts our State out of the program.
How did this ever happen that the state could take possession of property by punishing the elderly?!?
How would these congresscritters like it if this happened to their loved ones that didn't have immediate family members to ensure their loved ones weren't going to lose it all to the State?!?
I do remember meeting someone at the State Democratic Convention when it was held in Fort Worth and he was going through the same thing with his grandfather as far as the State taking ownership of his property.
Please be aware of this and make sure anyone you know who is elderly is protected from this happening to them. This is a wake up call.
On Edit: My neighbor has always been a very good neighbor and had one of the nicest lawns and well cared for properties on the block. She took great joy and pride in working in her yard.
