Chance of resolution to Dane County case before November election is dim

Madison - The chances that a legal battle over checks on voter registrations will be concluded by the Nov. 4 election grew more slim Wednesday, when a Dane County judge said she won't rule on the merits of the case until 12 days before voters go to the polls.

Once Sumi rules on Oct. 23, either Attorney General J.B. Van Hollen or the Government Accountability Board, the agency Van Hollen sued, could appeal.

Even if an appeal went directly to the state Supreme Court, bypassing the Court of Appeals, it would leave little time for the high court to act by Nov. 4.

As it is, local election clerks say they don’t have enough time to conduct the voter registration checks that Van Hollen wants.
