Here is a specific Ohio law Blackwell violated--I need help getting arrest
I posted on another thread that I wanted the citizens to stand up and hold Ohio Secretary of State Blackwell accountable for his actions by having him arrested. I found a specific Ohio law that he violated (and in my opinion, should be incarcerated for):

THE LAW

Ohio Revised Code Title XXXV Elections, Sec. 3503.26 that requires all election records to be made available for public inspection and copying. ORC Sec. 3599.161 makes it a crime for any employee of the Board of Elections to knowingly prevent or prohibit any person from inspecting the public records filed in the office of the Board of Elections. Lastly, ORC Sec. 3599.42 states: “A violation of any provision of Title XXXV (35) of the Revised Code constitutes a prima facie case of election fraud within the purview of such Title.”

THE CRIME BY BLACKWELL

"Blackwell decided to stop the legal recount being conducted in Greene County Ohio, in mid-count. When the volunteers asked under what authority they were being stopped they were told that Ken Blackwell had determined that “all voter records for the state of Ohio were “locked-down,” and now they are not considered public records.”

So, now that we have the specific crime Blackwell committed, what do we do to get a DA to file charges?

2. Here's what you do
Round up about 100 or so willing people to help perform a citizen's arrest. Warn the police and DA that if they don't act to arrest Blackwell, then your posse will. Don't give them a chance to respond, just inform them. Then go do it. They'll have him arrested lickety-split in order to avoid a confrontation.

That simple.

Evidently I made so much sense pointing out how dangerous of an idea this was on the original thread that someone felt the need to to create a new thread where the idea could get even more outrageous and stupid.

It's not that I'm not with you guys in spirit, but except for the people who talk about going to a lawyer, the d.a., or the police (properly), this idea is just nuts. Why stop at Blackwell? Why not just pull a citizens arrest on W.? or his Dad? or ANY of his Brothers?

18. I was thinking that the volunteers in Greene County could let the DA know
what happened. I don't live in Ohio, so I am not sure if I could do anything myself. But, those that were personally affected--the volunteers in Greene County that were unlawfully denied access to records by Blackwell--might be able to file a complaint with the DA's office citing the law I mentioned above. I am not sure how Ohio law works, so hopefully there are some lawyers here that could provide feedback (I've never had to file charges through the DA's office either--anybody know if it is hard?) Thanks again for everybody's input into this--I am thinking we should try to get in contact with the volunteers in Greene County and see if they are willing to file a complaint with the DA (anybody know if this sounds reasonable?)

As far as I can see you've been pretty reasonable and I didn't mean to slam you directly, as I said in the other thread doing this in effigy might be cool. It's not a bad protest idea at all. Watching Michael Moore trying to pull it off in the same vein as "Roger & Me" would be great!

So, I'm not trying to rain on you or your good idea. It's when people start talking about posse's and bouncers and handcuffs that things need to be reigned in.

the possibility of a citizens' arrest initially, but it seems to me that there is a lot of sense in what you say, Red State Blues.

The idea that the law, even in the most advanced democracies (and in US elections, any and every electoral crime, however outrageous, seems to be initially touted as "political" and, when it suits them and they think they can get away with it, the laws themselves, as mere "pieces of paper"!) is not created, *directed* and maintained by some very louche individuals in high places, is simply naive. If your lawyers express their approval, even tacitly, that's different. Try and get an opinion.

If it comes to making a citizen's arrest, at least bear in mind now, the kind of forces you will likely be dealing with, and that there is already a wealth of damning evidence your lawyers have already brought to the attention of the courts. It seems to me inconceivable now that the cover-up will not explode in their face. Success can only be delayed, not thwarted.

5. Here's an email I just sent to Moore:
Several members of www.democraticunderground.com have pretty much determined that Ken Blackwell broke the law (see: http://www.democraticunderground.com/discuss/duboard.php?az=show_topic&forum=203&topic_id=154253#154281). We'd like your help to perform a citizen's arrest on him.

Here's the plan... we really want to force Ohio DA's/Police to arrest him on felony violation of the law, so we'll get together a crowd of people (at least 100) and call it the Blackwell Posse. We'll inform them of the Posse's intent to perform a citizen's arrest on Blackwell. This will force them to either stop the Posse or arrest Blackwell themselves. Eitherway, it will draw serious attention to the laws the Blackwell has broken. You would be extremely helpful in drawing a massive crowd of Ohio citizen's to be part of the Posse.

What do you think?

The line between "posse" and "mob" is precariously thin. I imagine to the Ohio government that it is nonexistent. If you're lucky, they'll tell you to fuck off and go home. If you're unlucky, then the Ohio NG will be called out to "disperse the mob." I trust the pecadillos of the Ohio national guard need no elaboration.

As to what happens when you attempt to "arrest" Blackwell, I suggest you watch "Assault on Precinct 13."

From what I have been reading, it is probably best to go to the DA's office first and try to file charges. I am not sure how that process works in Ohio, so maybe if we have any lawyers that are reading you could help? Somebody said that freeperpeepers were signing the above petition? Do you think that if you bring a signed petition to DA's office it might motivate them to want to take action? Just some thoughts.

30. Talked to my friend--she says we should be able to at least sue
Blackwell for his crimes. She was not sure if the Cobb volunteers would be the ones who would have to press charges, though. Hopefully we can get in contact with the volunteers and ask them to please press charges against Blackwell.

I sent the petition over to my friend for analysis. Here is what she says:

"The petition gets a lot wrong. For instance, the Greene County recount had not begun when this occurred. They were doing research for the recount, which is another thing entirely, and which blows the whole petition out of the water as a result. I wouldn't recommend circulating the petition, as the only real use of something like this is as a PR ploy, and that will backfire because of the misinformation involved. No, the DA's office wouldn't be motivated by a petition like this."

So, we should think of a different strategy or make a new petition

42. Here's the catch: the records were being examined by Green volunteers
while the law requires a DEMOCRAT and a REPUBLICAN both to be present during the recont examinations. Since there were none present only the Greens, they decided to take the records away.
