Was there any mention about MSM's suit against Blackwell
over exit polling?

COMPLAINT against J Kenneth Blackwell, filed by Plaintiffs American Broadcasting Company Inc, The Associated Press, Cable News Network LP LLLP, CBS Broadcasting Inc, Fox News Network LLC, NBC Universal Inc, 11/01/2004)

Blackwell apparently issued a directive on October 28, 2004 to prohibit the news media from conducting exit polls within 100 feet of polling places. MSM alleged that Blackwell exceeded his authority by issuing the directive to the County Board of Elections

"On Thursday, October 28, 2004, Plaintiffs’ representative was informed by a county elections official that he and other officials had been instructed by Defendant in a telephone conference call on Thursday, October 28, 2004 to prohibit exit polling within 100 feet
of polling places in the State. Dozens of attempts on Thursday, October 28, 2004 and Friday,October 29, 2004 to clarify this report with the Defendant’s office were unsuccessful."

"Not until after the close of business on Friday, October 29, 2004 did a representative from Defendant’s office, Keith Scott, return a call to Plaintiffs’ attorney. During this call, Mr. Scott confirmed that Defendant had orally instructed the county boards of election not to permit exit polling within 100 feet of Ohio polling places (the “Oral Directive”)."

"The Secretary of State exceeded his authority in issuing the Oral Directive because, as he previously conceded, no Ohio law, including Ohio election laws R.C. §§ 3501.30,3501.35, or 3599.4, regulates, addresses, or in any manner restricts the conduct of exit polls in
Ohio on election day."

An Ohio judge issued a temporary restrainting order in favor of MSM. The suit is still ongoing.

2. I thought the 100ft only applied to party campaigning. But this
is quite interesting.
Thanks.

7. No Problem
It is interesting Blackwell attempted to prevent news media from conducting exit polls.

15. Have you read it?
There was no move to stop exit polling. Just not within 100 ft. of the polling place. That's about 30 yards.

While I agree that he didn't have this authority, it looks a lot more like he was just trying to keep the media a few yards away from the entrances to the polling places.

3. Seems to prefigure the Repubs move against exit polling
It's as if they had something to hide!

Taken together with his other actions, this really seems to show Blackwell taking steps to cover up election fraud. By disrupting exit polls, he would remove one source of evidence.

Despicable. I hope this guy takes the fall to as low as he deserves. If he really did what it looks like he did in this election, that would be total disgrace and a prison term.

5. Blackwell would look fine in an orange jumpsuit.
But I'd be happy to see him excused if Rove could take his place.

8. Not only that, Blackwell needs to be investigated for
costing the taxpayers so much money in lawsuits.

4. There were plenty of discussions on this before the election
here at DU. If you can search, you might want to hunt them up.

Merry, Kerry Christmas!

12. Blackwell and Rove story
Blackwell and Rove were taking a walk down a country road in Ohio, discussing future political moves. Suddenly Blackwell notices
some recent rabbit pellets laying across the path in front of them. Blackwell picks up one and asks Rove, "what are these?" -- Rove takes a look and mutters "oh, those, they are smart pills." "Smart pills, you say?" Blackwell looks a little closer and pops one in his mouth. "Tastes like crap!" Rove smiles and quips, "See? You're getting smarter already!!"

13. Hmmm
I don't recall hearing about this. But November 1 seems like a lifetime ago. When I could sleep.

Questions:

1) Could this have something to do with why they will not release the raw Mitofsky Data? Because it is somehow involved in this suit? I don't think so -- but, anyone?

2) My favorite Blackwell moment has to be the 80 lb. paper trick. That was gooood. What's yours?

16. They should be suing for being locked out
of the count due to the "terror threat" that didn't occur. wonder if that will happen.

and you know i find it funny, well not funny but strange that on election day his majesty and co. flew into Ohio to great his supporters. the weather was terrible that day but it didn't stop him.

i remember it because FOX made it sound like Kerry didn't care about Ohio (figures)because he didn't make an appearance there. you know what a chicken that jk can be afraid of a little rain. i hat fox.

17. The Nevada Secretary of State (don't remember his name)
Edited on Sat Dec-25-04 09:02 PM by scubed
was VERY negative about exit polls on 12/7/04 in DC at the Common Cause meeting. Was spouting all the crap that the MSM was printing, but he also claimed that he had not allowed exit polling in NV. Anybody know about this?

20. The 80lbs paper trick is my favorite as well heres why...
The link below will take you to the Franklin County Board of Elections. For those that are not aware Columbus the Capital, is in Franklin County. Guess what you will find at their site? It has been there all along, even when Blackwell first brought this trick into play. You will have a laugh.

I couldn't seem to find that requirement on that form either!
I know it's a moot point, but you have to give it up for the Ol' College Try!

Thx!

19. Has it been confirmed that Blackwell has bloced access to vote logs
There were posts earlier to the effect that Blackwell has blocked the recount people and citizens access to the county voter log books, which is a violation of Ohio law. What is the status of this?
Was access blocked in all counties or just a few counties, and is access still blocked.
There were reports that recount people had found indications of fraud on the log books in counties such as Greene and Trumbull, but I haven't heard much about this lately.

21. I saw evidence of this
... at my polling place.

They placed a flag 100 feet from the doors of all polling places. All political signs or campaigning had to be done outside this boundery. The morning of Nov 2nd my wife and I placed all our extra Kerry signs at all the polling places in our suburb, just outside the flags. (We had about ten signs for each polling place.)

When I left the polling place Move-On was taking an exit poll right by the flag. I wounder if these exit polls are available from Move-On?
