Just got off the phone with a bunch of the people involved
I am, of course, eating my own face here. Everyone I talked to who is hands-on in this thing told me to relax, breathe deeply, the filing is going to happen today. I am told it will happen by 5pm, and I will get the documents once that happens, but because of the PACER filing system, it might happen after 5. In other words, I'm in hell.

I spoke to the court clerk - nice man - and he said nothing new had appeared on the docket, but stuff doesn't show up on the docket until 24 hours after filing.

I'm sorry this is stretching out so much. If anyone thinks I am enjoying this, they're crazy.

24. the lawsuit filed by the greens was dismissed and kerry is joining in to
revive the effort, because he alone can show he suffered damage due to voting irregularites. Funny, I thought all of us had a compelling interest in fair elections!
Anyway, he is supposed to be adding new charges to the original suit as well. hopefully in the next hour!

Which lawsuit are you talking about? Was there a court action of dismissal in any relevant lawsuit--or are you just talking about the "temporary restraining order" (TRO) matter (that Greens can't show irreparable harm, to immediately stop the state from doing something)?

Denial of a TRO is not the same thing as a dismissal. TRO has a higher standard of proof because it stops some action--prevents harm to litigants or their case; whereas a dismissal throws the whole lawsuit out of court--dead, fini (unless court permits a re-filing).

Could someone just very briefly give status of the lawsuits? And which of them is Kerry intervening in?

K-E involved. This is an action the campaign's attorneys are taking separately from the glibs. More than in support of the recount, they are asking to be able to conduct discovery and have the "evidence" (voting machines?) preserved.

As promised, the full text of the statement to Countdown from the evening of December 23 of Daniel J. Hoffheimer, State Legal Counsel, Ohio, Kerry-Edwards 2004, Inc., (and, yes, he’s referring to himself in the third person here):

“Daniel Hoffheimer, State Legal Counsel for the Kerry-Edwards campaign, told MSNBC today that Kerry-Edwards will support the third-party candidates in asking the Federal Court in the Ohio recount lawsuit to order the preservation of the evidence obtained during the recount and to expedite discovery of the facts. Hoffheimer said that various problems and errors have occurred in a number of Ohio's 88 county boards of elections during the recount, which will conclude next week. Hoffheimer acknowledged that the most publicized of these problems was the machine manipulation in Hocking County but said that the developing evidence will reveal other problems as well. He said that Senators Kerry and Edwards are very concerned that the law for conducting the recount should be uniformly followed. They want to be sure that all circumstances involved in the Ohio election, including the recount, should be put before the Court and disclosed to the American people. Only then, Hoffheimer said, can the integrity of the entire electoral process and the election of Bush-Cheney warrant the public trust."

Will someone please clarify the legal situation. Third-party candidates in Federal Court (as per above)? Arnebeck (Alliance, Common Cause, voters) in State Court? What is the impending Kerry legal action? In which suit? (Or new filing?) I've lost track and it's been a lo-o-o-ong holiday weekend! (I know, I can search DU for this, but if someone can save me that effort, I would be grateful.)

Arnebeck's suits (there are two, split from one) in OH SC.
Original Glibs suit (back when I was young) that K/E already joined.
New filing by Glibs in Federal Court last Friday.

K/E -- filing a new suit or joining the Glibs in Fed Court?

I'm gonna need a scorecard -- nice to see I'm not the only one.

77. Yes, and it looks like it was filed.
Third party candidates: Greens and Libertarians (Cobb and Bednarik) or "GLIBs" are suing for a recount and the case is in Federal court; Arnebeck is claiming fraud and the case is at the State Court level.

KE is filing as intervenor (basically a party that has entered the lawsuit after initial filing to protect its own interests) and is asking on its own behalf to have the evidence preserved and to conduct discovery. It is a new filing and goes above and beyond just joining in on something the GLIB's are doing -
