Richard Hayes Phillips Declaration: "Direct Evidence of Ballot Tampering"
This declaration filed in court on 9/1/2006 contains Phillips' findings to date in his recent examination of 2004 ballots and other records in eleven counties in Ohio. These findings lead him to the conclusion that "there is direct evidence of ballot tampering".

Pursuant to 28 U.S.C. 1746, I, Richard Hayes Phillips, declare the following:


1. I have personal knowledge of the facts alleged herein.

61. Having reviewed a substantial amount of forensic evidence, it is my conclusion that
there is direct evidence of ballot tampering in each of the eleven counties whose
public records I have examined, and that there is a compelling need to protect the
evidence from destruction, presently scheduled to take place on or shortly after
September 2, 2006. The Court should order all Boards of Elections to continue to
preserve and protect all ballots, poll books, voter signature books, and associated
records from the November 2, 2004 election until a suitable repository is found for
their permanent preservation.

I declare under penalty of perjury that the foregoing is true and correct.

"In Clermont, irregularities and hostilities were the order of the day, according to three eye witnesses who gave affidavits to the Conyers committee. Stephen Spraley, an electrician and Ohio Democratic Party recount volunteer, offered a report of major significance. He saw a number of ballots with oval white stickers placed next to the candidate’s name and covering the Presidential selection. Spraley approached Assistant Board Director Kathy Jones, a Democrat, with a ballot on which a Kerry choice was covered with a sticker. Before Jones could speak, Dan Bare, the board chairman, said this would be addressed later at a board meeting. At the meeting, the board agreed that the stickers were part of a process in Ohio to avoid spoilage.

Spraley called Carolyn Betts, who was working as a recount observer in Hamilton County. Betts has both MBA and JD degrees, as well as impressive experience with white collar crime, fraud cases, and contentious financial transactions. Betts confirmed Spraley’s observations and concerns about altered ballots found during the recount. This observation carries added weight because it is contemporaneous and consistent with Spraley’s. Betts noted that Danny Bare said that using white sticker on candidate selections was an acceptable means of fixing ballot problems prior to vote counting. Betts also noted that Spraley told her he had asked to take a photograph of one of the altered ballots and was denied this request."

Tell him there will be a quiz and he needs to be prepared. What a bunch of wimps. Their own poll shows major problems (special issues) and they cave in like a cheap pup tent. Sweet!

I can't imagine what it's like. Of course everybody knows its corrupt...everybody, they just won't admit it and it must be aggravating in the extreme and even laughable at times.

I'm promising to show up at the Strickland inauguration just to feel see the joy and get a little satisfaction myself from all that's gone on.

Ohio deserves much better, particularly the activists.

Get 'em...and keep on that Dispatch guy. They deserve it.

so I'll hazard a guess.

The most obvious explanation would be that some of the original supply of ballots were used to commit fraud like ballot stuffing. They are supposed to retain the unused ballots and the spoiled ballots for the same amount of time as the voted ballots so that they can later be audited to show that the actual number of unused ballots is equal to the number that should have been left over from the original supply. The only purpose of these control measures is to make it more difficult to commit fraud.

If they were trying to surreptitiously order ballots after the election that they would be able to slip in as if part of the original supply then this would be a clear indication of criminal ballot tampering.

Edit: apparently I haven't had enough coffee yet. I should probably have said "ballot swap" instead of "ballot stuffing". With just straight stuffing then the accounting of ballots would have looked okay. But if they swapped out true ballots, discarded them, and replaced them with "punch party" ballots then the accounting wouldn't add up correctly. Or if they just discarded some of the true ballots without replacing them. Either way they would need to order up some ballots if they wanted the count to come out right.

Pardon my cynicism, I just voted today and could not believe there actually was a line to use the electronic machine. People freely hand their vote over without a paper trail.

Although it seems, even with a paper trail nobody cares. They suck on their big gulp and watch TV, screaming that we're tearing America apart because we want the results to actually be counted correctly.

I can see one problem with Phillips' argument, it is possible that a long series of Bush votes could be cast in a row if a busload of Republicans had just come in from some fundamentalist church of Satan.

Is the idea that the sticker is applied later on top of a ballot marked for Kerry - then revoted for Bush? So, these would have been tampered with between when they were voted and when they were counted?

Aren't their bi-partsan people involved in counting the votes? This looks too blatant not to be noticed. How is this coming out now? Have they released things not seen before? (Even RFK jr, who seemed to have investigated relatively thoroughly had nothing like this.)

- I would be thrilled (and infuriated at the Republicans) if Kerry really won.

during the so-called recount.

Here's one link about them.

About your "bi-partisan people" question, the answer is yes and no. County Boards of Election in Ohio do have to have employees who are registered Democrat and employees who are registered Republican. However, anybody can register in any party or change their registration, right? I think it was in Ohio that the term "DINO" was coined. It stands for "Democrat in Name Only." Poke around a bit and you'll find examples where the "Democratic" staff people in Ohio BOE offices were anything but.

Time to be thrilled and infuriated. Kerry really won.

And oh, BTW, RFK didn't so much investigate thoroughly as he (and at least one other person who worked on the article, I believe) reviewed work by people like Richard Hayes Phillips and Bob Fitrakis and restated it to a larger audience.

Are Republicans or DINOS, or anything but Democrats

Perhaps there are a few places qualifying aws exceptions
like CHicago Illinois and Boston MA but the overall
status of electionofficials is Republican.
That is why even in liberal Marin COunty, you have People
like Elaine ginnold and Michael SMithwho talk about being
registered "Independents" but who act like they are the
Diebold payroll

This suit is being aggressively pressed forward in US District court in Columbus by Cliff Arnebeck and a team of elections lawyers before Judge Algernon Marbley, a Clinton appointee who is as serious as a heart attack about enforcing equal protection and due process in the Ohio electoral system. This is Blackwell's worst nightmare.

Enough with the nay saying.

Stop wringing your hands and use them to write this team a $25 check!

As someone noted upthread, he is a geologist, indeed a geomorphologist, by training. So, certainly a researcher and a scientist. Certainly conversant in mathematics and statistics, although those are not his fields. A "private investigator" in the sense that he has conducted investigations on his own -- no relation to Sam Spade. Also a self-described "lyric poet" and "wandering minstrel" (http://web.northnet.org/minstrel/). A man of many talents, but not of multiple personalities.

I've never met RHP, but I think he's done good stuff, although I disagree with some of his statistical extrapolations.

Gifted people, as this man no doubt is, are not just gifted in one area, as a general rule. They are gifted in many areas.

No surprise to me that he is versatile and multifaceted as a personality.

It's a stereotype in American culture that the more dedicated one is to one area, the better or more professional one is. Simply not the case.

I would hold up Febble as another example. Not long ago I was googling for one of her New Mexico analyses, or something like that, and came across a review of a performance that included one of her compositions for voice.
