Status of RFK Jr's lawsuit?
Edited on Fri Dec-08-06 12:43 AM by garybeck
Last update I heard was they were waiting to see if the Government was going to take the case, and if they chose not to, then RFK and Pap would be able to pursue the case themselves (so they were hoping the gov't did not take it on). I remember Mike saying that the Government had 60 days to decide, but I never heard about the decision they made and it's been much more than 60 days. Did anyone catch what happened with that?

just wondering

4. Listening to Ring of Fire between the lines...
Papantonio was not on the program this past month. RFK Jr. said he was working on a big case in Ohio.

Hmm... Interesting that he said Ohio. RFK Jr. could have just said he was working on a case and stopped there.

10. I Googled to find out what Pap is up to in OH and it looks like he might be
involved in a different case right now. there's some kind of class action lawsuit relating to welding products. unfortunately this court document doesn't say the date, so I could be way off base, but he is listed in the Plaintiffs’ Executive Committee:

5. Apparently the 60 days can be extended.
From a BradBlog interview of Mike Papantonio on 8/2/06:

BB: About qui tam: I understand that when you file, the government has the option of taking the case, instead of the citizen who files. Is that true?

MP: Correct.

BB: Is there any chance that the government might take the case and then go ahead and spike it?

MP: You mean sit on it?

BB: Yes.

MP: Yes, that’s exactly everybody’s fear, and that’s what we are trying to work around right now. The answer is, yes, that could very well happen, and we’re doing the best we can to not allow it to happen. Interestingly enough, within 60 days they have to make a decision, the decision if they are going to take the case, and they have a right to have one extension, they can get one continuance for that decision, so that’s one thing we have to be very conscious of.

BB: That can leave the disclosure until after the election then.

MP: Oh, absolutely. We’re trying to do what we can in that regard too.

I'm sure that Brad would have covered it so no news must mean that it is still in a phase where they're not allowed to talk about it.

8. Shouldn't we know if there was an extension? and if
there was one, I would think that's expired by now too.

good info eomer.

me thinks, this suit could end the madness faster than anything. if the companies are found guilty of criminal action, that is the monkey wrench we've been waiting for.

6. Another angle.
I read somewhere that if the US AG doesn't take up the suit then they (Kennedy and Pap) could go to state AGs and if the state AGs don't pick it up then they would do it themselves. In the meantime Ohio has elected a Democrat (Marc Dann) to be AG and Dann made a campaign promise to prosecute violations in the 2004 election. So I wonder whether the Ohio AG being willing to take up the case would end the qui tam lawsuit and then the Ohio AG would take the reins. (Caveat: This is just speculation on my part and IANAL.)

Here's where I read that about going to state AGs if the US AG declines (don't know if it is correct or not):

The contents of the suit could be under judicial seal for at least 60 days while the U.S. Department of Justice considers whether or not to join the suit. If U.S. Attorney General Alberto Gonzales decides not to join the suit, Levin Papantonio may approach individual state attorneys general. If no one joins, the firm is free to, as Papantonio puts it, "stand in the shoes of the Attorney General and fight on behalf of the taxpayers and the nation."

7. Excellent speculation eomer, and would explain the delay (waiting for Dann
to take office.

Also would explain why Blackwell is too busy to help Brunner transition (shredding evidence).

12. I think Pap & Kennedy have to weigh the benefit of staying quiet a while
longer with any benefit from going public. They've said several times that they have had people "pretty high up" in voting machine companies who are coming to them as whistleblowers. Maybe the case is even going forward right now and they are deposing voting machine employees. They may be working to gather as much information as possible before going to court, so that they can have maximum impact in court. It may be better to keep the story out of media right now.

My big hope: A BIG $$$$$ award from the lawsuit means that BIG $$$$$$ are poured back into states and counties so that they can replace ALL DREs with voter-marked paper ballot systems.

By the way - were you, by chance, listening to Mike Malloy (on NovaM) a few weeks ago when a caller said that he had a lot of inside information about the theft of the 2004 Election? Mike urged him to take it to Conyers, I wish Mike had told him to contact Levin Papantonio...
