I've just completed my second day in Concord and other parts of New Hampshire with Bev Harris, Kathy Greenwell of Bullett County, Kentucky, and Jeannie Dean of Sarasota, Florida. We have been monitoring the chain of custody of the ballots being transported by a van which is sent out each morning from the State Archive Building in Concord and is driving a route to little towns around (so far) south New Hampshire, stopping at Town Hall buildings in each town to pick up that town's ballots for the recount. While the Democratic recount has been taking place inside the Archive Building in Concord, with lots of transparency and observors sitting across from each table, we've been chasing a van and a police car through the New Hampshire countryside, sometimes at 80 to 90 mph in 55 mph zones, to track ballot chain of custody custody for the interested voters of America.

"Bring peanut butter and Depends!"

Our advice for those who will take our place once we leave.

There are no lunch breaks on this gig, and no bathroom breaks either!

"Butch" and "Hoppy", the van driver and his assistant, have certainly done their best to "shake" us, and they succeeded yesterday with a shrewd escape from a back exit of a town hall parking lot which was not visible from where our car was parked in front. "I thought they were turning around to go out the front driveway!" I moaned to Bev, when we realized they had split out the back way. We never did find them again, but saw several hours later when the van arrived back at the Archive building to deliver the boxed ballots. No citizens were present when those boxes arrived. And we just don't know exactly where the van was during those 2-3 hours prior to delivery.

Yes, this is what "eternal vigilance" looks like this week in New Hampshire!

My experience as a Realtor has come in handy as I've been on many a Realtor tour where we "caravan" from one new listing to another, speeding every inch of the way. I had to run a yellow light yesterday to keep up with the targets, and at the next town hall where we followed the van and the state police car, the patrolman came over to my little rent car and gave me a stern warning that I might receive a citation if I broke the law. ("What about YOU?" I said to him, under my breath of course.)

But today it was the patrolman who got a lecture, this time from Bev. Kathy, whose husband is a policeman in Kentucky, noted that their speeding through a school zone with yellow lights flashing, and going 50 in small towns with speed limits of 25 and 30, was endangering children, citizens, and of course, US, as we fly along behind them trying to keep up. Bev decided to mention this to the NH patrolman today when the race was on again, while we were parked in one of the town hall building parking lots waiting for Butch and Hoppy to bring out the boxes of ballots (we had done a lot of videotaping of ballot boxes coming out of the offices & going in to the van yesterday).

After the lecture, the van and police car were easier to track because they really did stay more in line with the speed limit. We had a little more time to enjoy the snow-laden fields and yards of the beautiful New Hampshire countryside while we followed the two vehicles from towns such as Rye, Portsmouth, New Castle, Auburn, and Greenland.

Still, they managed to give us the slip again this afternoon by doing a clever elusive maneuver: They pulled into a convenience store/gas station and made a U-turn, then turned into a busy lane of traffic which was too congested for us to follow right behind them. We madly passed all the cars we thought were between us, then realized they were nowhere in sight. We parked our two cars in front of a furniture store while we called Walter Reddy, who was back at the Archive building, and asked him to write a Freedom of Information Act request for Secretary of State Bill Gardner to request the schedule of towns where the van was headed. With that information, we could probably catch up with it. Just as Bev was giving Walter the wording for the FOIA over the phone, in a scene reminiscent of a Laurel & Hardy movie, the van and police car suddenly drove right by us, apparently having double-backe d from a wrong turn, and now putting us right back on their tails!

It's the chain of custody, STUPID!

When this is what citizens have to do to ascertain that ballots have not been tampered with, and this is the resistence we face, how can we have confidence in the results of this recount?

When we returned to the Archive Building late yesterday afternoon I finally got to watch some of the Democratic recount. The procedure is open, transparent, and citizen videographers are welcome; they just can't touch the ballots or the ballot boxes. Fair enough.

Four long tables are set up in a large room. Counters sit on one side, observors on the other side. They sort, count, and stack the ballots, with pink strips across the top of the Republican ballots and blue strips across the top of the Democrats'. The actions of everyone in the room are highly visible. I took lots of video tape and no one complained. The procedure reminded me of the way VoteRescue volunteers count paper ballots after a Parallel Election, or Exit Poll results at the Texas Straw Poll and the November 6th election.

Problem is this chain of custody thing. Bev and Sally Castleman found ballot boxes last Thursday with slits in the sides. The van picking up the ballots has hours of time unaccounted for by any citizens and regular monitoring of the van may or may not be able to occur. The ballots are delivered outside the observation of citizen monitors. Boxes of ballots were left on the floor of the counting room overnight last week and not locked up in a vault in the building, counter to prior procedure just days before. The security of these boxes is supposedly a long adhesive seal afixed across the box tops and sides. Today we found a box of these lying around in the counting room after the events of the day were over. Kathy peeled off the paper backing and stuck the seal on top of one of the empty ballot boxes sitting next to it. She peeled it right back up. No muss, no fuss, no cardboard fragments from the box top adhered to it. In other words: Completely reusable, and security value: ZERO!

What all of this does, of course, is put a dark cloud of suspicion on the results of this recount.

Today Kucinich's team threw in the towel and ended their part of the recount. By 3 pm the counting room was vacant and all ballots stored away. What I'm hearing is that the money for continuing the recount simply isn't there. I do not yet have the results of this effort. I have heard that weird anomalies have shown up in the machine counted towns' ballots in particular. I'll be doing another writeup on those findings as soon as I can.

Tomorrow the Republican recount begins. I met Albert Howard on Tuesday, the Republican presidential candidate who filed for the recount and paid for it in full, something along the lines of $55,000 (with the help of the Granny Warriors and a lot of campaign contributions, many, I hear, from Ron Paul supporters.) I admire his courage and tenacity. When he filed for the recount, the filing fee of $2000 was a challenge to produce. Now the money to recount the entire state has been paid to the Secretary of State and the process begins anew tomorrow.

The most amazing thing about all this is being here with Bev, Kathy, Jeannie, Sally, Walter, and other election reform activists who share a burning passion to make this recount a clean event. They come here from all across the country to observe, videotape, monitor, question election officials, and yes, chase down vans and police cars. Bob Schulz of We the People Foundation is here doing webcasts for the duration of the recount, I hear, and I hope to meet him tomorrow.

Bob Schulz, founder and head of 'We The People' is an interesting character, to say the least. A right-wing Libertarian, who ran for NY Governor on the Libertarian ticket, promotes income tax avoidance scams, landing many of his naieve, ardent followers in prison (not to mention "Schulz is under investigation by the Internal Revenue Service in connection with an alleged failure to file Federal income tax returns for years 2001 through 2004"). One dupe of this huckster plea-bargained and is serving seven years instead of 13 counts at 5 yrs each.


JUSTICE DEPARTMENT SUES ROBERT L. SCHULZ AND “WE THE PEOPLE” TO STOP ALLEGED TAX SCAM

Queensbury, N.Y., Man’s Scheme Allegedly Cost U.S. Treasury $21 Million

WASHINGTON, D.C. - The United States announced that it has sued to block Robert L. Schulz, of Queensbury, N.Y., from selling an alleged tax fraud scheme said to have cost the U.S. Treasury more than $21 million, the Justice Department announced today. Also named in the suit are two corporations, We the People Foundation for Constitutional Education Inc., and We the People Congress Inc.

The government’s complaint, filed in Syracuse with the U.S. District Court for the Northern District of New York, alleges that Schulz has used the two We the People entities to market a nationwide tax fraud scheme, called the Tax Termination Package, to employers and employees. According to the complaint, the Tax Termination Package includes We the People forms, which the defendants falsely tell customers can be used to replace forms the IRS requires employers and employees must use in connection with federal tax withholding from wages.

The suit says that Schulz and the We the People entities falsely state that use of the replacement forms will allow customers to legally stop tax withholding. According to the complaint, the defendants base the scheme on frivolous arguments about federal tax laws that federal courts have repeatedly rejected. “People who sell tax scams are asking for trouble for themselves and their customers who participate in them,” said Eileen J. As part of our 100Q set that commemorates tax scam artists, we add Bob Schultz, who currently runs "We the People". In addition to getting out the words on tax protestor strategies guaranteed to win a visit to the U.S. Bureau of Prisons, "We the People" shamelessly markets Interactive CD-ROMs on the unofficial "Truth in Taxation Hearings" for $29.95 and Bob Schultz's own "Tax Termination Package" for $39.95 containing various materials that Bob has sent the IRS and Congress over the years (and which undoubtedly were immediately placed into "File 13" where they belong).

"We the People" is also associated with indicted tax scammer and fellow Quatlooser Lynne Meredith. But not withstanding the indictment, "We the People" has continued to be one of the most aggressive marketers of bogus materials, going so far as to run full-page advertisements in USA Today (which you can -- shock -- also buy reprints of). They also sell phone services and similar junk more befitting of a bad multi-level marketing website than a group which purports to be political in nature.

But cheesy is as cheesy does. For his part, Bob Schultz has put on a show worthy of any professional wrestling extravaganza, threatening the IRS to arrest him (this was predictably toned down after Lynne Meredith was indicted) and even going on a hunger strike to draw attention to himself. Does Bob himself really believe this junk or is he just another 2-bit scammer with a penchant for wild marketing? Although Bob is obviously a few fries short of a Happy Meal, it is also evident that he is trying to make as much moolah as possible before the door slams on him too.

Notably, to try to squelch criticism and keep the scam alive, "We the People" have attacked websites such as Quatloos! that have criticized them, including signing us up for literally tens-of-thousands of spam e-mail messages (thank goodness for spam blockers!). Another bit of BS he promotes:


“We The People” .... the court permitted testimony that the group’s leader advocated filing UCC-1 financing statements against anyone with whom an individual had a grievance, in order to cloud their credit and clog the legal system.


'We The People' is the organization that filed a lawsuit for hand-counted ballots.

Interesting comment by Nancy Tobi:

This 10-state (now supposedly 50) lawsuit is being lobbed by a heretofore unheard of group (at least unheard of to those of us involved in the election integrity movement), including one fellow involved in tax evasion issues and at least two known racists, including one (our NH plaintiff) who serves as both town moderator (chief election officer) and apparent cult leader.

In email correspondence with a known attorney in the election integrity movement, Plaintiff Bob Schulz admits they don't necessarily have the resources (financial or otherwise) even to fight the suit in each state.

This all begs the this question: is the lawsuit we want to have defining election law for us?

Are we being set up to take a fall from a badly organized, unfunded, questionable lawsuit?

Jim March, Bev's partner in crime... oops! ... I mean BBV Board Member and Qui Tam beneficiary, is also a proud member of The Republican Liberty Caucus, the "libertarian wing of the Republican party", whose most recent past chairman was Ron Paul.

So when the Dems wouldn't have her (DU, KOS), and even the repubs wouldn't have her (freerepub), she has now found $$RonPaul$$ folks, and has her creds in proper order.

Remember, that award that was supposed to go right back into bbv and never quite got there or on her taxes.

First Thanks to all of you
I made the statement that Bev Harris published Albert's phone number on the net. That is exactly what I was told. I got a message from Bev stating it was not her and would I make the correction. My answer was that as soon as I found out I was wrong I would certainly make sure everyone knew it was a mistake. I will try to find the truth but cannot see a reason for anyone lying to me about this.

Albert Howard being harrassed !
I got a call from Albert Howard today, he is very upset, it seems that Beverly Harris ( Black Box Voting ) has listed his phone number on the internet. His phone is being called over and over and he is just trying to rest today after a very tiring and stressful week. He told the Hotel that he didn't want to be disturbed and still someone rented a room down the hall from him and banged and banged on the door. When he didn't answer the fellow told the hotel he was a business partner and something was wrong with Albert and had the door opened. Albert is such a nice man and does not want to be mean.. Not at all like me.... Please people quit calling him. He wants to have some peace and quiet for a few hours..

We paid for another hotel room for the next 3 days on our credit card. No one will be told where it is so maybe he can get some rest.

I am really disgusted with Miss Harris, why in the world would anyone put his phone number on line???? Not a very trustworthy deed.

Anyway the money did not go to the new account it went back in my account. Now we hope to have it straight by in the morning and we can talk the Sec of state into accepting the money.

Bev Harris and L Landis were at the original meeting with Albert and Eric and said they were actually beligerent and demanding and really pissed off the SOS with their demands for computer parts being examined etc. They had already agreed to allow us to video the recount and were co operating until the BlackBox ladies showed up and demanded more and more. Albert said he hugged the SOS when they left and asked him to please not hold a grudge against us but he then demaded the money immediately before 3 PM. Hopefully we can get him to change his mind with some nice phone calls letting him know we are not accusing him of any fraud just we want to have our votes recounted....

10. Typical Bev.
She put my personal info online for having the audacity as a member of the public (as provided by law) to ask for a copy of the organization's non-profit 990 form.

She does this constantly... posts shit she shouldn't, then scrubs it & denies it.

4. In LA County, some of the ballots are delivered by helicopter. Impossible
to pursue observation of chain of custody here...People have been requesting chain of custody documents for over 2 years now and haven't gotten an answer yet.
