Blackwell Violates Ohio State Law?
This deserves a new thread, and do we want to media blast it?

The thread records evidence that Blackwell ordered an election official to deny a voter access to poll books.

Then Carolab posted this.

<§ 3599.16.1> § 3599.161. Prohibiting inspection of election records.

(A) The director of elections, deputy director of elections, or an employee of the board of elections designated by the director or deputy director shall be available during normal office hours to provide any person with access to the public records filed in the office of the board of elections.

(B) No director of elections, deputy director of elections, or employee of the board of elections designated by the director or deputy director shall knowingly prevent or prohibit any person from inspecting, under reasonable regulations established and posted by the board of elections, the public records filed in the office of the board of elections. Records relating to the declination of a person to register to vote and to the identity of a voter registration agency through which any particular person registered to vote are not public records for purposes of this section.

(C) Whoever violates division (B) of this section is guilty of prohibiting inspection of election records, a minor misdemeanor, and shall, upon conviction, be dismissed from his position as director of elections, deputy director of elections, or employee of the board of elections.

HISTORY: 137 v H 86 (Eff 8-26-77); 145 v S 300. Eff 1-1-95.

The effective date is set by section 3 of SB 300.

This looks like Blackwell may have done something contrary to Ohio statute which, if he did do it, would mandate his dismissal. I word this cautiously because libel law comes into play here. So let's be careful how we discuss it, but let's also not fail to seize the moment.

1. that is so odd you bring this up
i was just going to make a post (or at least reply in a thread) that in my gut, i honestly think Blackwell is gonna go down for something, i thought that the first time i ever heard of him or saw his face.

Anyway, what can be done about it? I would think the only person who can take this to court is the girl who had it happened to her (i do remember hearing this story in the recording of the hearings).

3. Well, For One thing, we might publicize that this has reportedly
happened, and at the same time publicize the statute. How much do you want to bet this is not the only person who had this experience? I'll bet that more one than one person has asked to see poll books in Ohio and been denied...It seems to me that "they" are getting very desperate and starting to do really stupid things...signed poll tapes in the trash in Volusia, prohibitions on statutory rights to examine polling books in Ohio...the heat's turned up, and the crooks are scared. That's when the start doing even more stupid things to cover up the already stupid things they've already done. When that begins to happen, you know that you need to turn up the heat even more....

He's a fool -- someone has promised him something bright and shiny if he pulls this off(like Governor) and he's such a Dumbass Tom he's going for it -- Sadly men like him always become the roadkill in these situations.

Ah well... dance with the devil, they say... no better for him.

22. Arnebeck was involved in those hearings
and they were taking affidavits, so this is probably old news. If you haven't (or perhaps have) heard about the lawsuit filed, Arnebeck is involved, and it's based on testimony from those hearings.

4. Blackwell probably considers himself to be "untouchable"
He was probably assured that no matter what, his a** will be covered.

However, Katherine Blackwell probably has no idea whatsoever of the degree of animosity which is growing towards him and his flagrant disregard and lack of respect for American voters.

I don't consider the people of Ohio to be the "rollover" type. They should be angry, and do something about it, if Blackwell is abusing his position.

7. Whistleblower? New Thread?
Hi---could someone help me out here? I picked up an interesting article before the election:

Board Of Elections Worker Resigns

Worker Doesn't Give Reason For Resignation

POSTED: 5:52 pm EDT October 24, 2004
CLEVELAND -- The Cuyahoga County Board of Elections said the woman in charge of the absentee ballots resigned, NewsChannel5 reported.

Board of Elections Director Michael Vu said Sondra Robinson did not say why she was resigning.

Robinson worked for the board of elections for three years.

I found it fishy at the time, but have never seen a followup. Does this perhaps warrant a new thread? I'm pretty new DU and don't know the protocols that well yet.

Maybe this woman could be a whistleblower.

But I agree this is important. Are you in Ohio? Or can some other Ohio person try to contact her? As many have been saying here, we have statistical evidence in spades; all we are waiting for are some people to come forward and supply some direct testimony and evidence for the tampering schemes which produced the numbers. This sounds like a very likely candidate. Can you follow up on your own insight?

PS -- I just emailed Arnebecker with a short report on the allegations here, just very "matter of fact" -- "I understand that this would be a violation of Ohio law..." etc. Not as good as the actual complainant stepping forward, but maybe if she or someone else does, he will have been forwarned and aware of the wider public scrutiny and public interest.

I'd love to see Blackwell go down for this -- most especially for he's done to Ohio African Americans through his grotesque voter suppression tactics.

12. Sondra Robinson--Whistleblower?
Hi, yes, I'm in Ohio and have tried to find information about SR. The only thing I've found so far was an odd 2002 posting on FindLaw:

"Mr. Conover. What if someone intercepts your mail, makes copies of it and threatens to blackmail you with it? My Ex accessed my email account AFTER he moved out. Then he made copies of it. I would like to take legal action but do not know where to begin. Any help would be appreciated."

Then it gives her email address, which I'm not including, since I have no way of knowing if it's even the same SR. Still, it kind of made the hair on the back of my neck stand up.

About the Blackwell thing... the lawyers are on it. I've been working a little bit with a vote count/recount group and was at the hearing. Testimony at the hearings, BTW, were under oath, and there were lawyers there. I'm sure this woman was contacted.

Emailing SSR and just politely asking her if that is who she is. If not, there's little lost. If so, then you could carry forward with a conversation.

Also, what about Vu? Would be be easier to locate, and perhaps you could find her through him?

8. I'd still like to know why Blackwell was allowed to chair Bush's campaign
in Ohio. As the person who oversees elections in the state, that looks like a major conflict of interest to me.

Blackwell has aspirations of running for governor in 2006. I hope he goes down in flames. He's been nothing but a stooge for the far-right for the past couple of years. And this election debacle is the icing on the cake.

Ya, I think you can say that again. And again. And again. & etc. ad nauseum. Its just pathetic that they can get away with it. But probably there's no law *per se* against it. New federal legislation is required. But that's a battle for another day.

For now, I say we hold Blackwell's feet to the fire. It was harder to do that with Harris because she had Jeb and the whole rotten clan of Bushes directly behind her, but Blackwell is more exposed, and also having seen it happen once before, we can mobilize our outrage this time to make damn sure it doesn't happen again.

The repbulicans in the congress just sent a clear sign to the country that ethics are no longer required, and no one seems to be complaining too loudly, except here.
