COBB SEEKS FEDERAL COURT JURISDICTION IN NEW OHIO RECOUNT CASE
I just received this email.

GREEN PARTY PRESIDENTIAL CANDIDATE SEEKS FEDERAL COURT JURISDICTION IN NEW OHIO RECOUNT CASE

11/30 -- Attorneys for Green Party presidential candidate David Cobb asked a federal court today to take jurisdiction of, and ultimately dissolve, a temporary restraining order issued by a Delaware County, Ohio judge attempting to prevent Cobb from seeking a recount of the presidential ballots cast in that county.

Cobb and Libertarian Michael Badnarik, who are jointly filing the recount demand, are named as defendants, along with their attorneys, in the restraining order sought by the Delaware County prosecuting attorney.

The Delaware County judge issued the temporary restraining order without contacting or seeking any input from the candidates or their attorneys.

"This is an illegal and outrageous attempt to suppress our
rights to participate in the democratic process. As a candidate, I have a right under Ohio law to demand a recount. If the Delaware County Board of Elections has a problem with that, they need to take it up with the Ohio legislature," said David Cobb.

"It makes you wonder if Delaware County has something to hide. Why else would they try to prevent a recount and issue an injunction without giving the candidates any notice to participate?" asked Cobb-LaMarche Media Director Blair Bobier.

Cobb and Badnarik initiated the recount demand on November 19 by sending letters and the appropriate bond to each of the election directors of Ohio's 88 counties, requesting a hand count of the votes in every precinct in every county in the state. The total cost of the bond, based on the number of precincts in which a recount is demanded, is $113,600.

Support for a recount in Ohio is growing on a daily basis. On
Sunday, the Reverend Jesse Jackson held a press conference and rally at a Columbus church and announced his support.

The Cobb-LaMarche campaign is now in the process of recruiting volunteers and raising funds for monitoring the actual recount process. Volunteers and donors should visit the campaign website, http://www.votecobb.org, for more information. Information about the Green Party can be found at http://www.gp.org.

2. Wow - these guys are amazing!!
""It makes you wonder if Delaware County has something to hide. Why else would they try to prevent a recount and issue an injunction without giving the candidates any notice to participate?" asked Cobb-LaMarche Media Director Blair Bobier."

And I think that's the question everyone is asking. THANK GOD for third party candidates!!

(Never thought I would say that) - but being a liberal from Massachusetts, I tend to change my mind ...would that make me a flip flopper?

Thanks so much for posting this OSO!

4. That's it! Enough!
How do I talk to these people? I need to talk to these people. I have phone numbers for campaign managers, etc. I'll try them first.

I am sick of this nonsense already. A recount will not help. If they want to change the outcome, they need to look at the data that we do have to prove that the election was rigged. We can PROVE it!

7. Here are contacts for the Cobb campaign.
Write them. Tell them that if Mr. Cobb wants to change the outcome of this election that we have forensic evidence to show that Kerry would have won in a legitimate election. Tell them to contact me at jackpanella@yahoo.com.

I will write to them, too, with all the details, but I've been writing to people for a week, and I don't know that I'm getting through to anybody because all I get are automatic replies. I'm tired of wasting my time. I need to speak to a human being.

6. From the post above
it looks like Bush got fully twice as many votes as Kerry in this county. Do we really think a recount will do anything?

8. in 2000 the Supreme Court bounced jurisdiction back to the Fla courts
what makes Cobb-LaMarche think they'll get federal jurisdiction now?

9. because the ruling in * v. Gore was only for that one case.
They said that was the only time it was to be applied that way.

One reason why this whole first term was illegal.

11. Bush v. Gore has been used by the courts since.
The courts have already referred to Bush v. Gore. I don't remember the specific case, but it involved a state race or a congressional race. If I recall correctly, someone mentioned in a DU thread a week or so ago.

The court can't keep another court from referring to its ruling. SCoTUS may have intended their ruling in Bush v. Gore as a one-offer, but it doesn't work that way in reality.

10. It's just amazing, really.
Greens are going to court to demand a recount.
If anything, they could lose votes in a recount, if any Kerry votes were counted for Greens. They truly are heroes.
