Man sues after being hit by flying hot dog at Royals game
Kansas man sues Royals over Sluggerrr’s hot-dog toss

Everybody who takes in a baseball game at the K knows to be aware that a foul ball could be headed at their noggin at any moment. (Home runs? Not so much.)

But who would think to dodge an errant hot-dog thrown by Sluggerrr, the team’s mascot?

A Kansas man sued the Royals earlier this month, alleging that just such a flying sausage struck his left eye, detaching his retina and causing cataracts.

“While doing so, (Sluggerrr) attempted to throw a hotdog into the stands with a throw behind his back,” the suit alleged. “Instead of throwing the hotdog at an arch high into the stands, (Sluggerrr) lost control of his throw, or was reckless with his throw, and threw the hotdog directly into plaintiff, who was sitting a few feet away.”

Why are you so personally invested in stopping someone from pursuing a perfectly good claim for negligence?

When one enters a baseball stadium, one doesn't consent to having their retina detached. While play is under way, they do consent to the risk of foul balls, but his wasn't a foul ball. It was a sausage thrown apparently at close range. It likely went far short of its mark, hitting someone nearby instead of sailing upward to others not so close.

We have a body of law that defines negligence actions, and if some guy goes to the park and gets smacked in the eye by the mascot, it's probably negligence.

3. If he didn't notice a giant yellow lion (?) throwing a sausage at him,
maybe he had the eye problem to begin with. :)

Seriously, if the thrown sausage did in fact cause the damage I think the team should be responsible for his costs, but I did not know that cataracts could be caused by impact like that...

6. If he was lucky enough to have the retina reattached, the ensuing
vitrectomy would give him a cataract very quickly (within weeks or months rather than years.)

Been there, done that. The team, or concessionaire, should pay.

9. that's true, my husband had cataracts in both eyes after his vitrectomies
and let me tell you, surgery to reattach a retina is NO WALK IN THE PARK, nor is the recovery from the surgery any fun at all

23. Interesting, I did not know that. And I guess a detached retina is not the sort
of thing one ignores to go to a ball game, so it's not particularly likely that it's preexisting.

It could be an interesting case - perhaps it will hinge on whether flying concession items are or are not known and accepted hazards at a game - but I agree the suit is a reasonable one. My guess is the team settles out of court...

If it was your retina, we'd be reading a thread with 200 replies about how wronged you had been, and how much they owed you for it. That's how these things are - hilarious and silly unless it's your eye.

27. Eyes are a big deal. I have scratched my cornea a few times
before, and it is rough, no doubt, BUT I have a hard time believing a hot dog could cause that much damage. I am not saying it is impossible, but it is a hot dog. At baseball games, you take chances getting hit by a ball. A hard ball. I have been hit with a foul ball before, and it hurts. If this were me, and he really does have a detached retina, I would chalk it up to bad luck. I guess it just seems people are so sue happy these days.

I could see if the guy was hit with one shot out of the airgun at point blank - but a toss?

And he will probably lose if they Royals follow the Braves. The back of every Braves ticket tells you that you enter the ballpark at your own risk and the Braves are not liable for injuries sustained from flying object (such as foul balls, flying bats etc) and specifically warns people to pay attention to what's happening on the field.

(SF Giants) and I've thought about how much damage they could do if the corner of the box hit someone in the eye.

(but then, I've personally had a detached retina so I tend to worry about such things)
