Re: Prop 8. How can this be?

This is probably a pointless post, but I cannot believe that I'm seeing headlines in the San Jose Mercury News and SF Chronicle saying that the Supreme Court of California is leaning towards leaving Proposition 8 intact.

What the fuck is going on here???? What did I miss?????

Is this the same Supreme Court of California that ruled it was absolutely unconsitutional to deny same sex couples the right to marry?

At the risk of repeating myself, I would have bet my house, car and everything I own that this was a dead and gone issue, and that Prop 8 was not only illegal and unconstitutional but not even legally permitted to be on the ballot in the first place.

This is so disgusting.

Please tell me the journalists are wrong and that this is NOT a "confusing" or legally "controversial" issue. How can it be?

Anyway, I am so sorry. I feel so bad for the GLBT community tonight. This is an obscene situation, and so unfair. This is so wrong it is hard to even comprehend.

but it is important to remember it is not over yet. Even if they rule unfavorably, this is not over. There will be a day when we are all free- with liberty and justice for all.

I hope this works out for them in the next opportunity. Seeing the stats makes me think it'll be better in 4 yrs

but now that Prop 8 passed and changed the constitution, it is constitutional.

That means that we could put an initiative on the ballot to tax the churches or to take away the vote from blacks and women, and if said initiatives passed by a mere 51% majority, it would change the CA constitution and the effect of the initiative would be binding and not reviewable by the courts.

The justices are in effect saying that any ballot initiative that changes the CA constitution cannot be ruled unconstitutional, unlike any law passed by the state legislature, unlike any executive order issued by the governor, or unlike anything that carries the force of law in CA and that is normally subject to judicial review. They are saying that the only way to rule that Prop 8 violates the constitution is to propose another ballot initiative that would overturn Prop 8 at the constitutional level. Sounds like a recipe for disaster, with gay marriage appearing on the ballot every fucking election cycle in an endless see-saw battle.

This is madness.

Unfortunately the people will never be given that much power, but just for a moment, imagine what could be accomplished.

I was at a rally yesterday; hundreds of young people who have been against this prop. from the beginning will be ready to vote to repeal it (they will be eligible to vote in 2010).

We WILL get it gone - as soon as we can.

And, the hardright will be sorry that they ever started this. Two sides can play at the amendment game. Perhaps we will seriously modify the citizen's ability to modify the constitution, without the pre-approval of the legislature.
