Taking bets on the outcome! - Court splits sharply on campus Christian argument
Court splits sharply on campus Christian argument
By The Associated Press
04.19.2010 12:34pm EDT

(Washington) Supreme Court justices seemed to split sharply on whether a law school can legally deny recognition to a Christian student group because it won’t let gays or non-Christians join.

The court heard arguments from the Christian Legal Society, which wants recognition from the Hastings College of the Law. Lower courts threw out a lawsuit trying to force the school to make it a campus organization.

Chief Justice John Roberts and Justice Samuel Alito questioned the school’s lawyer sharply, saying that being forced to admit someone who doesn’t share their beliefs was a threat to the group. But Justices Ruth Bader Ginsburg and Sonia Sotomayor pressed the group’s lawyer on notion that if they can ban gays, other groups can legally ban women and minorities.

1. yeah, it's that value system
These extremists want the law of religion to override the law of the land. In this case they believe their religion grants them immunity from having to conform to the requirements for obtaining funding that every other group must comply with, or not receive funding.

Nobody is telling them they can't ban gays. Just that they can't ban gays and expect funding. God damn cults everywhere, and about as rational.

2. They are free to not include anyone they want -
and to not get official recognition or school funding.

It is a bullshit case with no merit which SHOULD be thrown out. The rules are very clear that they cannot discriminate and get school support. If they accept school recognition and support they must open their doors TO PEOPLE WHO WILL NOT JOIN ANYWAY.

Personally, I don't care if the Klan has by-laws prohibiting Jewish atheists from joining - I'm not going to join because I know that I would not be of a like mind with them anyway.

If I was gay, I wouldn't join a group that wants to 'cure' me.

And that brings up another question - aren't these people supposed to be reaching out to the sinners? Why are they trying to get to court to say they can discriminate against the very people that their supposed mission is to save?

They should not only not get school funding, they shouldn't get their denomination's funding either.

4. Good point. I kept wondering why anyone gay or non-Christian would want to join
but that should be their choice. If this group chooses to discriminate, well, they can if they want. But then they shouldn't be sitting their with their hats in hand asking for school funding.

Seems pretty clear cut to me. But I am not a law person

5. WHAAAAAAT? Roberts and Alito can't see the problem with this?
But I thought they were supposed to be such exemplary legal scholars! :sarcasm:
